AN ORDINANCE REPEALING MUNICIPAL ORDINANCE NO. 1, SERIES OF 1960, OF THE MUNICIPAL COUNCIL OF CATARMAN, MISAMIS ORIENTAL, COMPELLING THE OWNERS OF ASTRAY OR DOMESTICATED ANIMALS TO IMPOUND THEM, ETC.
Section 1
To establish and maintain municipal pounds, to regulate, restrain, and prohibit the running at large of domestic animals, and provide for the distraining, impounding and sale of the same for the penalty incurred, and the cost of the proceedings; and, to impose penalties upon the owner or owners of said animals for the violation of this Ordinance in relation thereto, and/or shoot the running at large of stray or domesticated animals.
Section 2
The owner or owners of stray or domesticated animals, like hogs, goats, sheep, horses, carabaos, and cows must impound them.
Section 3
The owner or owners of stray or domesticated animals enumerated in Section 2 hereof caught inside the plantation planted to bananas, camotes, cassavas or other cereals belonging to another person or persons shall be charged to pay to the municipal government the amount of Ten Pesos (P10.00) f it is of large cattle as horse, carabao, or cow, and five Pesos (P5.00) if it is a sheep, goat or hog; otherwise, said animal or animals will be shot.
Section 4
The owner or owners of stray or domesticated animals enumerated in Section 2 hereof caught outside of any agricultural plantation, or on the streets, public or private plazas, private or public markets shall be charged to pay to the municipal government the amount of Ten Pesos (P10.00) if it is of large cattle and Five Pesos (P5.00) if it is sheep, goat or hog, otherwise, said animal or animals will be shot.
Section 5
The owner or owners of stray or domesticated animals found or caught in the plantation enumerated in Section 3 hereof shall be subject to pay any amount worth for the damage caused on the plants in the plantation where said animals were/or are caught.
Section 6
PERSONS AUTHORIZED TO SHOT STRAY OR DOMESTICATED ANIMALS. Any member of the Police Force or any rural police of this municipality, by order of Superior Authority shall shoot stray or domesticated animals as provided for in Section 3 and 4 above. The owner or owners of any plantation, who have duly licensed firearms or firearms, are allowed to shoot or boloed stray or domesticated animals found inside his/or their plantations, provided, with the knowledge or consent of the Barrio Captain in the locality.
Section 7
PENALTY – The owner or owners of stray or domesticated animals found violating or does not and/ or do not comply with any part or parts of the provisions of this Ordinance shall be fined the amount of not less than Twenty-Five Pesos (P25.00) nor more than Fifty Pesos (P50.00), or an imprisonment of not less than Ten days (10) nor more than Twenty days (20), or both fine and imprisonment at the discretion of the court.
Section 8
REPEALING CLAUSE – Any Ordinance or parts thereof which are inconsistent with any part or parts of any of the provisions of this ordinance are hereby repealed.
Section 9
EFFECTIVITY – This ordinance shall take effect on August 10, 1964.
