1966 ORDINANCE NO. 4 - Astray/Domesticated Animals (Repealing Ord. No. 3 of 1965)

AN ORDINANCE REPEALING ORDINANCE NO. 3, SERIES OF 1965 OF THE MUNICIPAL COUNCIL OF CATARMAN, SUBPROVINCE OF CAMIGUIN, MISAMIS ORIENTAL, COMPELLING THE OWNER OF OWNERS OF STRAY OR DOMESTICATED ANIMALS TO IMPOUND THEM, ETC.


Be in enacted by the Municipal Council of Catarman, Sub-province of Camiguin, Misamis Oriental, that:


Section 1

PURPOSE: To established and maintain a municipal pound and fix the fees for poundage – to regulate, restrict or restrain, or prohibit the running at large of stray or domesticated animals, and provide for the distraining,, impounding and the sale at public auction of the same for the penalty incurred and the cost of the proceedings or for killing in the event of failure of sale; and to impose penalties upon the owner or owners of said animals for the violation of this ordinance in relation thereto.


Section 2

The owner or owners of astray or domesticated animals – like hogs, goats, sheeps, carabaos, cows, horses, asses, and all members of the bovine family must impound them.


Section 3

The owner or owners of stray or domesticated animals enumerated in section 2 hereof caught inside of any agricultural plantation belonging to another person or persons planted to bananas, camotes, cassavas or other cereals, or newly planted coconuts or nuts; any kind of plants for decoration purposes – whether inside or outside the fence of the owner or owners thereof shall be charged to pay to the Municipal government the amount of TEN PESOS (P10.00) each of a large cattle, such as carabaos, cows, horses, asses, and all members of the bovine family at the time that they were caught and/or on the day that they were impounded in the municipal pound, and the amount of ONE PESOS (P1.00) each animal foe every thereafter when still in the municipal pound and the amount of FIVE PESOS (P5.00) each of the following animals: hogs, goats, sheeps, etc, at the time that they were caught and/or on the day that they were impound n the municipal pound, and the amount of ONE PESO (P1.00) each animal for every day thereafter when still in the municipal pound.


Section 4

The owner or owners of stray or domesticated animals enumerated of section 2 hereof caught outside of any agricultural plantation, or on the streets, public or private plazas, public or private markets, or public and lands or places shall be charged to pay to the municipal government the amount of TEN Pesos (P10.00) each of a large cattle such as carabao, cows, horses, asses, and all members of bovine family at the time that they were caught and/or on the day that they were impounded in the municipal pound, and the amount of ONE PESO (P1.00) each animal foe every day thereafter when still in the municipal pound and the amount of FIVE Pesos (P5.00) each of the following animals: hogs, goats, sheeps, etc. at the time that they wore caught and/or on the day that they were impounded in the municipal pound and the amount of ONE PESO (P1.00) each animal for every day thereafter when still in the municipal pound.


Section 5

Any stray or domesticated animal or animals found not impounded or running at large on the streets, public or private plazas, public or private markets, public lands or places the owner or owners of which is and/or are known by the municipal authorities shall be charged to pay – upon proper notice by the Chief of Police or his authorized policeman to the owner or owners of the same the amount of TEN PESOS (P10.00) each if it is of a large cattle, such as carabaos, cows, horses, asses and all members of the bovine family. And if the owner or owners of said animals shall fail to pay said amount, they shall be charged to pay ONE PESO (P1.00)more each day thereafter: and the amount of FIVE PESOS (P5.00) each of the following animals: hogs, goats, sheeps, etc. And if the owner or owners of said animals shall fail to pay said amount, they shall be charged to pay ONE PESO (P1.00) more for everyday r each day thereafter.


Section 6

When after proper notice to the public and/or the owner or owners of any of the animals enumerated in section 2 hereof the owner or owners shall not pay to the office of the municipal treasurer the catching and impounding fees imposed or charged in section 3 and 4 hereof, and also when after proper notice to the owners of any of the animals enumerated in section 5 hereof they shall fail to pay to the office of the municipal treasurer the amount or amounts charged therein – the same or the aforementioned animals shall be sold at public auction by the municipal treasurer or his duly authorized representative after ten (10) days from the time or day that the stray or domesticated animal was impounded in the municipal pound and/or running at large; except carabaos, horses, cows asses and all members of the bovine family which shall be disposed of in accordance with the provisions of Section 534-544 of the Revised Administrative Code, and the General Administrative Order No. 1 – 1. Series of 1950 of the Bureau of Animal Industry prohibiting the slaughter of carabao, horses, mares and cows in relation to Republic Act No. 11.


The proceeds of the sale at public auction shall be or shall accrue to the general fund of the municipality.


Section 7

PENALTY: The owner or owners of stray or domesticated animals found violating or not complying with any part or parts of the provisions of this ordinance shall be fined the amount of not less than TWENTY RIVE PESOS (P25.00) nor more than FIFTY PESOS (P50.00), or an imprisonment of not less than ten (10) days nor more than twenty (20) days, or both fine and imprisonment at the discretion of the court.


Section 8

REPEALING CLAUSE: Any ordinance the provisions of which are inconsistent with any of the provisions of this ordinance are hereby repealed.


Section 9

EFFECTIVITY: This ordinance shall take effect immediately upon its approval.
