AN ORDINANCE REPEALING ORDINANCE NO. 5, SERIES OF 1965 REQUIRING ALL OWNERS OF PUMPBOATS AND/OR OUTBOARD MOTORS WHOSE HOME PORTS ARE WITHIN THE TERRITORIAL LIMITS OR JURISDICTION OF THIS MUNICIPALITY TO PROVIDE A RED LIGHT LAMP FOR THEIR PUMPBOATS AND OR OUTBOARD MOTORS AND TO WRITE IN BOTH SIDES OF THEIR BOATS THE WORDS: CATARMAN, CAMIGUIN, AND THE PLACE OF THEIR STARTING OR LEAVING AND LANDING IN THIS MUNICIPALITY WILL BE AT THE SEASHORE NEAR THE PUBLIC MARKET AS THE CHECK POINT.
Be it enacted by the Municipal Council of Catarman, Sub-province of Camiguin, Misamis Oriental, that:
Section 1
All owners are required to provide a RED LIGHT LAMP for their pumpboats and/or outboard motors whose home ports are within the territorial limits or jurisdiction of this municipality, and they should write on both sides of their boats the words: CATARMAN, CAMIGUIN.
Section 2
The place or check point for starting or leaving and landing of all pumpboats and/or outboard motors will be at the seashore near the public market of this municipality; except in emergency cases that the Barrio Captain is allowed and/or responsible to let a pumpboat and/or outboard motor leave or start at his barrio seashore when going outside of this municipality – but to first a certificate of clearance to the owner or owners of pumpboats and/or outboard motors and to furnish with a copy of said certificate of clearance the Office of the Mayor of this municipality.
Section 3
PENALTY: Any person or persons found violating the provisions of this ordinance shall be penalized as follows:
1st Offense: A fine of not less than FIVE PESOS (p5.00) and not more than TEN PESOS (P10.00), or an imprisonment of not less than five (5) days nor more than ten (10) days, or both fine and imprisonment at the discretion of the court.
2ND Offense: A fine of not less than ELEVEN PESOS (p11.00) nor more than TWENTY FIVE PESOS (P25.00), or an imprisonment of not less than eleven (11) days nor more than twenty five (25) days or both fine and imprisonment at the discretion of the court.
3rd Offense: A fine of not less than TWENTY SIX PESOS (P26.00) nor more than FIFTY PESOS (P50.00), or an imprisonment of not less than twenty six (26) days nor more than thirty (30) days, or both fine and imprisonment at the discretion of the court.
Section 4
REPEALING CLAUSE: Any ordinance the provisions of which are inconsistent with any of the provisions of this ordinance are hereby repealed.
Section 5
EFFECTIVITY: This ordinance shall take effect immediately upon its approval.
