AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 6, SERIES OF 1966, OF THE CATARMAN, CAMIGUIN, MUNICIPAL COUNCIL, PHILIPPINES, RESTRAINING AND COMPELLING OWNER OR OWNERS OF ASTRAY OR DOMESTICATED ANIMALS TO IMPOUND THEM.
Be it enacted by the Municipal Council of Catarman, Camiguin, Philippines, that:
Section 1
PURPOSE: To give inducement to farmers and citizens of this municipality improve their economic stability they increase of food production; to restrain and compel all owners of astray or domesticated animals to impound them; and to impose fine in violation thereof.
Section 2
Owner or owners of astray or domesticated animals, like pigs, goats, sheep, cattle, horses, carabaos, and all member of the bovine family, must impound them so that they may not destroy municipal streets, provincial roads, national roads, public and private plazas, plantations of other people, etc.;
Section 3
Owner or owners of animals or animal enumerated in Section 2 of this ordinance caught on the streets, roads, plazas, plantations, besides with the destruction made if any, shall be fined, in the case of cattle, horses, carabaos, and any member or members of the bovine family in the amount of nine pesos (P9.00) per head, plus one peso (P1.00) confinement fee per day, per head: in the case of pigs, goats, sheep, shall be fined in the amount of six pesos (P6.00) per head, plus one peso (P1.00) confinement fee per day and per head.
Section 4
The fine enumerated in Section 3 shall be prorated in the manner following:
P3.00 shall be given to the person or persons who did the catching of the animal or animals;
P3.00 shall be given as share of the barrio council where the animal or animals is/are caught and shall form part of the barrio council fund;
P1.00 confinement fee shall be given to where the animal or animals is/are impounded and shall form part of their fund; that this is in the case of cattle, carabaos, horses, an any member or members of the bovine family;
P2.00 shall be given to the person or persons who did the catching of the animal or animals;
P2.00 shall be given to the municipal government and shall form part of the general fund;
P2.00 shall be given to the barrio council where the animal or animals is/are caught and shall form part of their fund;
P1.00 confinement fee shall be given to where the animal or animals is/are impounded and shall form part or their fund; that is in the case of pigs, goats, and sheep;
Section 5
Any animal or animals enumerated in Section 2 of this ordinance impounded and unclaimed shall be sold to the highest bidder thru public auction after the twentieth day of impounding with due notice. Such notices shall be made by the respective barrio treasurer, if the animal/animals is/are impounded in his barrio; and be the municipal treasurer if in the municipal pound; Provided, that the notice shall be in writing to be posted at the entrance of the Barrio of Municipal Halls, as the case may be; Provided further, that a copy of such notice shall b furnished to all barrio treasurers of the municipality, stating the place, date, time and describing the animal/animals to be sold at public auction; and Provided furthermore, that no sale shall be conducted less than 15 days from the twentieth day if impounding.
Section 6
The male of the animal or animals thru public bidding, after deducting the fine and confinement fee, shall be equally prorated by the municipal government and the barrio council where the animal or animals is/are impounded;
Section 7
Owner owners of cattle, horses, carabaos, and any member of the bovine family impounded, shall present to the barrio treasurer, in case the animal or animals impounded is/are in the barrio the certificate of large cattle to show ownership, before same could be released;
Section 8
Any owner or owners of animal or animals herein mentioned in Section 2 found violating this ordinance for three times shall be fined in the amount of not less than Twenty Five Pesos (P25.00) nor more than Fifty Pesos (P50.00), nor more than twenty days (20), or both fine and imprisonment at the discretion of the court.
Section 9
Any ordinance the provisions of which are inconsistent with any of the provisions of this ordinance are hereby repealed.
Section 10
This ordinance shall take effect of March 1, 1968.
