1972 ORDINANCE NO. 1 - Amendment of Ord. No. 1 of 1968 - Astray Animals

AN ORDINANCE AMENDING MUNICIPAL ORDINANCE NO. 1, SERIES OF 1968, PARTICULARLY SECTION 3, 4, AND 8, RESTRAINING AND COMPELLING OWNER OR OWNERS AF ASTRAY ANIMAL OR DOMESTICATED ANIMAL TO IMPOUND THEM.


Be it enacted by the Municipal Council of Catarman, Camiguin, Philippines, that:


Section 1

PURPOSE: To give inducement to farmers and citizens of this municipality improve their economic stability through increase of food production; to restrain and compel all owners of astray animal and domesticated animal to impound them; and to impose fine in violation thereof.


Section 2

Owner or owners of astray animal or domesticated animal like pig, goat, sheep, cattle, horse and all members of the bovine family, must impound them so that they may not destroy municipal streets, provincial roads, national roads, public and private plazas, and plantation of other people.


Section 3

Owner or owners of animal enumerated in Section 2 of this ordinance caught on the street, road, plaza and plantation, besides the destruction made if any, shall in the case of carabao, cow, horse or any member of the bovine family be fined of twenty four pesos per head plus two pesos per head of animal per day of pasturing and pig, goat, sheep, be fined of twelve pesos per head of animal, plus two pesos per head of animal per day of impounding.


Section 4

The fines enumerated on Section 3 of this ordinance shall be distributed in the manner following:


For large cattle and members of the bovine family:


P10.00 per head of animal shall be given to the person or persons who shall catch the animal.


P10.00 per hand of animal shall be given to the barrio where the animal is caught and pastured, plus the pasturing fee of two pesos per day per head of animal. Such that the amount shall form part of the barrio fund.


P4.00 per head shall be given to the municipal government and shall form part of the general fund.


For pig, goat and sheep:


P5.00 per head of animal shall be given to the person or persons who shall catch the animal.


P5.00 per head of animal shall be given to the barrio where the animal is caught and impounded, plus two pesos pounding fee per head of animal per day of impounding. Such that the amount shall form part of the barrio fund.


P 2.00 per head of animal shall be given to the municipal government and shall form part of the general fund.


Section 5

Any animal enumerated in Section 2 of this ordinance impounded and unclaimed shall be hold to the highest bidder thru public auction after the twentieth day of confinement and proper notice be given by the barrio treasurer, in the case of the barrio where the animal is impounded, and the municipal treasurer, if the animal is impounded in the municipal pound; that the notice be posted in conspicuous place or places and shall state the place, date, time and description of the animal to be sold to public auction.


Section 6

That after the sale all charges contained in Section 4 of this ordinance, plus the necessary expenses in connection with the public bidding, if any, shall first be satisfied and whatever is the balance be given to the owner of the animal.


Section 7

Any person or persons claiming ownership of any animal impounded or pastured, must show evidence of ownership before the release of such animal.


Section 8

Any owner or owners of animal herein mentioned found violating the provisions of this ordinance shall be fined of not less than thirty pesos nor more than sixty pesos, and in case of insolvency, shall suffer an imprisonment at the discretion of the court.


Section 9

Any provision the provisions of which are inconsistent with any of the provision of this ordinance are hereby repealed.


Section 10

This ordinance shall take effect immediately upon approval.
