1998 ORDINANCE NO. 4

AN ORDINANCE COMPELLING ALL CONCERNED TO CAUSE THE IMPOUNDING OF ALL ASTRAY ANIMALS SEEN ROAMING AROUND AD PROHIBITING THE PASTURE AND GRAZING OF GOATS, LARGE CATTLE. LIKE CARABAOS, COWS AND HORSES AND HOGS, ALONG THE ROADS AND IN PRIVATE AND PUBLIC PROPERTIES AND PLAZAS, WITHIN THE MUNICIPALITY OF CATARMAN, CAMIGUIN.


BE IT ORDAINED by the Sangguniang Bayan, in its regular session, the above-captioned ordinance:


Section 1

This ordinance shall be known as impounding of animals ordinance of 1998.


Section 2

All concerned shall be compelled to cause the impounding of stray animals, like hogs, carabaos, cows, horses, goats, dogs and like, seen roaming around in this municipality.


Section 3

All concerned shall be prohibited to:

3.1 Graze their respective animals in private and public properties or plazas, in the municipality, without the supervision of the owners concerned.

3.2 Pasture their respective animals in private and public properties, plazas, and along the national, provincial, municipal and barangay roads within this municipality.


Section 4

Penalty Clause. Violations of the provisions of this ordinance shall subject the violators to the following penalties:

4.1 A fine of P200.00, P100.00 of which shall be given to the catcher, P50.00 to the municipality; and P50.00 to the barangay concerned and twenty (P20.00) pesos daily subsistence of thirty (30) days imprisonment, or both at the discretion of the court.

4.2 Violations committed in the evening shall carry a double penalty, in the amount of P400.00, P200.00 of which shall be given to the catcher; P100.00 to the municipality, and P100.00 to the barangay concerned and twenty (P20.00) pesos daily subsistence or thirty (30) days imprisonment, or both, at the discretion of the court.

4.3 Unclaimed animals after seven (7) days of confinement shall be sold to the highest bidder, through public, auction, seven days after proper auction notice is posted in three conspicuous places in this locality.

4.4 Violators shall be collected the amount equivalent to the penalty provided in Nos. 4.1 & 4.2 of Section 4 of this ordinance, in case of out-of-court settlement, of which the money, after deducting the shares of the catcher and barangay concerned, will be paid directly to the Office of the Municipal Treasurer. Further, the actual damage of the property or plants, in case of out-of-court settlement, shall be assessed by both parties concerned in the presence of the investigating PNP Officer and the assessed amount shall be paid directly to the aggrieved party.


Section 5

Repealing Clause. All previous ordinances inconsistent with the provisions of this ordinance shall be deemed repealed and rescinded.


Section 6

Effectivity. This ordinance shall take effect upon its approval.
