AN ORDINANCE ON RABIES CONTROL WITHIN THE MUNICIPALITY OF CATARMAN, CAMIGUIN.
BE IT ORDAINED by the Sangguniang Bayan of Catarman Camiguin in its regular session, the above-captioned ordinance:
Section 1
This ordinance shall be known as RABIES CONTROL ORDINANCE OF 2000.
Section 2
DEFINITION OF TERMS: For the purpose of this ordinance, the following definitions shall prevail:
a) DOG – the term dog shall apply to a specific domestic animal (canis familiaris) male or female;
b) VACCINATION AGAINST RABIES –mean the inoculation of a dog with a rabies vaccine licensed for the species by the Bureau of Animal Industry, Department of Agriculture. Such vaccination must be performed by a licensed Veterinarian to be assisted by a trained livestock technician from the BAI, Provincial Veterinary Office and Municipal Agriculture Office;
c) OWNER – the term owner shall mean any person keeping, harboring or having charge or control of, or pertaining any dog to habitually be or remain on, or be lodged or fed within such person’s house, yard or premises;
d) RABIES CONTROL AUTHORITY – duly authorized person or persons responsible in the enforcement of this ordinance (police officers, BAI personnel, trained vaccinator, members of the Sangguniang Barangays, etc.)
e) HAS BEEN BITTEN – means has been seized with the teeth so that the skin of the persons has been wounded or pierced or scratched.
f) ENCLOSED PREMISES – means the owner’s house, or fenced yard, where other people have no reason to enter except to conduct business or visit with the members of the household;
g) RESTRAINED – mean tethered, leashed or caged;
h) PUBLIC POUND/MUNICIPAL POUND – shall refer to an establishment wherein astray animals or animals running at large shall be impounded or confined or restrained;
i) STRAY ANIMAL OR ANIMAL RUNNING AT LARGE – shall be understood to mean an animal which is loose, unrestrained, unconfined or not under complete control of its owner or the one in possession thereof.
j) ANIMAL CATCHER- one that performs actual catching of stray animals.
Section 3
MUNICIPAL RABIES CONTROL COMMITTEE:
A Municipal Rabies Control Committee (MRCC) shall be formed and shall possess the main authority of implementing this rabies control ordinance and other rabies control-related as it deem necessary. This committee shall be composed of the following members, subject to additional membership as the need arises:
1. Mayor - Chairman
2. Chairman of the SB Committees on Health and Agriculture
3. Municipal Agriculture Officer
4. Municipal Health Officer
5. PNP chief of Police
6. DECS District Supervisor
7. President, Association of Barangay Councils
8. Two NGO Representative
9. Provincial Veterinary Officer
10. Municipal Planning and Development Coordinator
11. The Parish Priest
12. DILG Representative
Section 4
RABIES VACCINATION
Every dog, 3 months of age and older, shall be submitted by the owner for vaccination against rabies every year or as indicated on the label literature of the vaccine, but in no case shall exceed 24 months. Young dogs shall be vaccinated within 30 days after they have reached 3 months of age.
Section 5
DUTIES OF VETERINARIAN
It shall be the duty of each veterinarian, when vaccinating any dog to complete a certificate of rabies vaccination (in duplicate) for each animal vaccinated. The certificate shall include the following information:
a) Owner’s name, address and telephone number (if any)
b) Description of dog (color, sex, markings, age, name, species and breed if any);
c) Dates vaccination and vaccine expiration (if known);
d) Rabies vaccination tag number
e) Vaccine producer
f) Vaccinator’s signature
g) Veterinarian’s license number/vaccinator’s address
The dog owner shall be provided with a copy of the certificate. The veterinarian/vaccinator shall retain on copy for the duration of the vaccination. A durable metal or plastic tag, serially numbered, issued by the veterinarian/vaccinator, shall be securely attached to the collar of the dog. These provisions, however, may not apply in a mass vaccination campaign.
Section 6
VACCINATION COST
The cost of rabies vaccination shall be borne by the owner of the dog at a cost agreed upon by the Sangguniang Bayan concerned.
Section 7
DOG REGISTRATION OR LICENSING
Dogs shall be registered by their owner upon reaching the of 3 months and every year thereafter. Unvaccinated dogs registered after reaching the of 3 months and dogs 3 months old and above not previously registered shall be vaccinated upon registration. The dog owner shall pay such registration fee as maybe determined by the Sangguniang Bayan. The registration officer shall provide the owner with a certificate of registration for the dog and affix to it a distinguishing collar tag as proof of registration.
Section 8
ELIMINATION OF UNREGISTERD DOGS.
Unregistered dogs over the age of 4 months shall be seized and humanely destroyed under the supervision of a licensed veterinarian or the Municipal Rabies Control Authority or vaccinated and registered under the provisions of Section 7.
The licensed veterinarian/trained vaccinator or the Rabies Control Authority shall give the guidance on the destruction methods to be used (shooting, poisoning, carbon dioxide anesthetics overdose) in different environments, (area of habitation, market place, rubbish dumps open countryside, etc.) The licensed veterinarian/trained vaccinator, the Rabies Control authority or a police officer may enter any land for the purpose of seizing or destroying a dogs which is liable to be seized under this section. The elimination shall be based on the presence or absence of a dog tag and/or a registration or vaccination certificate.
Section 9
REPORTING OR BITING INCIDENTS
The owner of a dog that has bitten a person and the person who has been bitten shall within 24 hours of the occurrence, report the incident to the Municipal Health Authority and the health care worker or the police officer receiving such information shall immediately transmit it to the Municipal Rabies Control Authority for investigation.
Section 10
LIABILITY OF OWNERS OF BITING DOGS
The owner of a dog that has bitten a person shall be responsible for all the treatment and dog examination-related expenses incurred by the bite victim(s) unless the bite was inflicted by a restrained and registered dog, or had occurred within the owner’s enclosed premises, in which case arrangements shall be made between the owner and the bite victim.
Section 11
ENFORCEMENT
It shall be the responsibility of the Local Government Unit of Catarman, Camiguin, to administer this ordinance and to promulgate necessary rules and regulations for its implementation. Enforcement shall be the responsibility of the Municipal Rabies Control Authority, defined under Section 1 of this ordinance.
Section 12
PUBLIC POUND/MUNICIPAL POUND
There shall be established or maintained public pound or municipal pound which is under the supervision of the Municipal Agriculturist. The site shall be designated by the municipal mayor.
Section 13
POUND NOTICE
Upon receipt of animals into the pound in charge shall advertise in the municipal hall building and barangay hall a pound notice for ten (10) consecutive days stating the following:
a) Color, breed and other description of the impounded animal;
b) The date and time when the respective impounded animals were caught;
c) The place or location where the respective impounded animals were caught;
d) A notice that unless redeemed, the animals will be sold at the public auction for cash to the highest bidder at said pound on the 11th day between 9:00 AM to 4 PM.
Section 14
LICENSES FEES/IMPOUNDING FEES
a) There shall be an annual license fee for each dog and cat raised within the Municipality of Catarman, Camiguin, in the sum of fifteen (P15.00) pesos plus the cost of the license tag in the amount of ten (P10.00) pesos;
b) There shall be charged for each animal impounded, to wit: P100.00
a) For each dog and cat
b) For each animal not redeemed and additional daily charge of ten (P10.00) pesos shall be imposed.
Section 15
IMPOSAL OF IMPOUNDED DOGS/CATS
All animals impounded, unless redeemed, shall be sold at public auction and those not sold at public and those not sold after two consecutive auctions shall be disposed as follows:
a) Healthy dogs and cats shall be donated to research institution or shall be killed humanely;
b) Other impounded animals shall be slaughtered for public consumption in accordance with existing laws and regulations.
Section 16
VACCINATION FEE
All impounded dogs from three (3) months old and up shall be vaccinated against rabies prior to the issuance of licenses, based on the following fees:
a) Dogs - P100.00
b) Cats - P100.00
Section 17
STRAY ANIMAL CONTROL
Stray dogs and cats shall be controlled by following the hereunder enumerated process or procedures:
a) Stray dogs and cats shall be removed from the community streets;
b) The pound is charge shall direct and supervise daily rounds for picking up strays;
c) Strays shall be impounded for ten (10) days to give owners enough time to reclaim their animals and to determine if human exposure has occurred;
d) Apprehended vicious strays may be destroyed at the discretion of the pound in charge;
e) Dogs found to be suffering from either of the two types of rabies shall be destroyed immediately.
Section 18
PENALTY CLAUSE
Any violation of any provision of this ordinance shall subject the violator to a fine of P300.00, for the offense; P600.00 for second offense, and P1,000.00 for the third and succeeding offenses, or not discretion of the court.
Section 19
REPEALING CLAUSE
Any ordinance or parts thereof inconsistent with the provisions of this ordinance shall be deemed repealed and/or rescinded.
Section 20
EFFECTIVITY
This ordinance shall take effect thirty (30) days from approval hereof
