2009 ORDINANCE NO. 2

AN ORDINANCE REGULATING THE SLAUGHTER OF ANIMALS AND BIRDS FOR FOOD, TRANSPORT AND THE DISPLAY AND SALE OF MEAT AND MEAT PRODUCTS.


Section 1

TITLE - This ordinance shall be known as “The slaughter, transport, display and sale of meat and meat products regulating ordinance of 2009.”


Section 2

POLICY STATEMENT -  It is the prime responsibility of the LGU to provide protection and security of the people as mandated by RA 7160 including among others the provision of safe, clean and sanitary food for the health of its constituents and ensuring a fair general welfare of all.


Section 3

DEFINITION OF WORDS, TERMS & PHRASES  - The following words, terms and phrases when use in this ordinance shall mean:


A. Abattoir - The Municipal abattoir or slaughterhouse established at Panghiawan, Catarman.

B. Abattoir Fee – shall refer to the fee and charges to the users of the abattoir and its facilities.

C. Birds/Big Birds – shall include but not limited to: Ostrich.

D. Large Cattle/cattle – shall include Cows, Carabaos, Horses and other like animals.

E. Slaughter of Animals – shall mean to butcher large cattle, hogs, big birds, sheep, goats and others.

F. Transport Fee - shall mean the service fee for the use of the Municipal Meat Van which shall have the responsibility of providing transport service for meat products from the Municipal Abattoir.

G. Designated meat stalls shall mean, the area assigned for the display and sale of meat in the Municipal Public Market.

H. Meat Shops – shall refer to the licensed stores intended to sell meat and meat products.

I.  Meat products – shall mean meat for food with added cost to preserve, and for specific food preparations like tocinos, corned beef, sausage of different kinds and similar items. It shall likewise include dressed chickens either in whole or in parts.


Section 4

REGULATORY PROVISIONS.


A. The slaughter of large cattle, hogs, sheep, goats, big birds and other animals for food either for commerce or for household consumption shall be made only at the Municipal Abattoir.

B. The transport of carcasses, meat and meat products produced at the Municipal Abattoir shall be transported only by the Municipal Meat Van from the abattoir to any point within the Municipality of Catarman. In no case, however, shall the Meat Van be used to bring into the abattoir livestock for slaughter at the slaughter house.

C. Display and sale of meat and meat products. The display and sale of meat and meat products shall be made only at the designated meat stalls at the Municipal Public Market. However, the said activity may be permitted at any licensed meat shops subject however to the existing requirements set by existing rules and regulations to include among others the sanitary and clean condition and the facilities to preserve protect the stuff from infections and decays.

D. Vending of meat outside the designated meat area in the Public Market and in streets in strictly prohibited.


Section 5

The Municipal Meat Inspector shall have the duty and responsibility to inspect the livestock, carcasses, meat and meat products to ensure the product, intended for food and human consumption, fit and in accordance with the existing rules and regulations. The Municipal Meat Inspector shall mark all carcasses and meat that passed the test and standard fit on human consumption before it would be released for display and sale in the market. He/she likewise has the responsibility to reject those that are not fit for human consumption and disposed the same in accordance with the adopted guidelines.


Section 6

SLAUGHTER FEES AND CHARGES – All users of the Municipal Abattoir and its facilities are required to pay the required fees and charges provided for in Municipal Ordinance No. 3, Series of 2001, at the Municipal Treasurer.


Section 7

MEAT VAND AND SERVICE FEES - The LGU shall provide the Meat Van transport facility to transport carcasses, meat and meat products from the Municipal Abattoir to any point within the Municipality of Catarman and for such service the users shall pay a service fee of P0.20 per kilo per kilometer from the abattoir provided, however, the fee shall not be less than P20.00 per head.


Section 8

PAYMENT OF SERVICE FEES & CHARGES - All persons required the pay the service fees and charges provided in Section 7 hereof shall be paid to the Office of the Municipal Treasurer. The Municipal Treasurer for convenience at her/his discretion may deputize any person to collect the said fees and charges from the users of the abattoir subject however, to existing rules and regulations.


Section 9

Any person violating any of the provisions of this ordinance shall be meted by a fine as follows:

1st Offense - P100.00 with reprimand

2nd Offense - P200.00 with warning

3rd Offense - Confiscation of the product and cancellation of the license.


Section 10

SEPARABILITY CLAUSE – if for any reasons part of this ordinance is declared unconstitutional of unlawful the parts not affected shall remain enforce and effective.


Section 11

REPEALING CLAUSE -  Any other ordinance, executive order or Memorandum, the provisions of which are contrary to this ordinance, are deemed repealed or amended.


Section 12

EFFECTIVITY CLAUSE - EFFECTIVITY CLAUSE - This ordinance shall take effect after its approval and all other requirements are satisfied.
