2010 ORDINANCE NO. 3

AN ORDINANCE CREATING AN EXTENSIVE FOOD PRODUCTION PROGRAM THROUGH COMMUNITY INVOLVEMENT AND FOR OTHER PURPOSES.

 

BE IT ORDAINED by the Sangguniang Bayan of Catarman, Island Province of Camiguin, in regular session, assembled:


Section 1

TITLE. This Ordinance shall be known and referred to as “An Extensive Food Production Ordinance of LGU-Catarman, Camiguin of 2010.


Section 2

DECLARATION OF POLICY. It is hereby declared to be the policy of the Local Government Unit of Catarman to promote the well-being of the townspeople, guide them to combat poverty through green revolution, and other productive activities, improve their quality of life and maintain a sustainable and decent means of living.


Section 3

SCOPE OF COVERAGE. The extent of coverage of this program includes but not limited to the following:


3.1 Tree Farming;

3.2 Vegetabe Production;

3.3 Planting a variety of crops;

3.4 Livestock raising;

3.5 Animal dispersal program;

3.6 Aquatic and Marine Culture;

3.7 Modern Fishing Technology;

3.8 Poultry Production


Section 4

DEFINITION OF TERMS. Unless the context otherwise indicates, the following shall be construed:


4.1 EXTENSIVE FOOD PRODUCTION. A wider range of agriculture development that includes the production of practically all crops and other sources of food, such as fruits, vegetables, potatoes, bananas, palay, corn, livestock, fowls, fish, seaweeds, and other domestic agricultural products not mentioned herein which may hereafter be possibly introduced or recommended for inclusion in this program by the Municipal Agriculture Office;

4.2 COMMUNITY INVOLVEMENT. A group participation among individual landowners, his authorized representative, or present legal occupants and/or farmers of the agricultural land duly identified under Section 5 hereof, and residents of the same community or barangay, who forged a covenant to render mutual help in the development of their respective farm land on a rotation scheme;

4.3 GROUP PARTICIPATION. Is an implementation of the aforementioned covenant by the group in a community who are committed to extend help to each other in tilling respective land areas for development, like land preparation, sowing, planting, weeding, harvesting, and other incidental farm labor on a round robin basis according to the order of preference drawn by lot.

4.4  LAND. Refers to an agriculture land, already inventoried, which may either be interpreted as real estate property, the property to be developed.


Section 5

INVENTORY/IDENTIFICATION. The Office of the Municipal Assessor, through its Department Head, with the assistance of office staff shall make an inventory of the agricultural land available for development and identify the registered owners, lawful occupants thereon, farmers and head of the family or every household thereat. This shall be accomplished within the period of fifteen (15) working days from the date of the passage and approval of this ordinance and to be updated every five (5) years thereafter.


Section 6

PRESERVATION OF RECORDS. Records of inventory and the names of registered owners and present occupants of the land referred to above shall be kept in the Office of the Municipal Mayor, the Municipal Archives and the Sangguniang Bayan for safekeeping and ready reference. The barangay, through its Barangay Captain, shall be provided with copy of records of inventory for easy monitoring. The Municipal Agriculture Office shall retain copies of same for its official file.


Section 7

ORGANIZATIONAL MEETING. One (1) week after the completion of land inventory, a general meeting of landowners, legal occupants of their respective agricultural lands, farmers, and head of the family for every household herein identified shall be held in their respective barangay to be presided by the Municipal Agriculturist or his authorized representative. With the presence if the Municipal Mayor and the Members of the  Sangguniang Bayan, to oversee the organizational meeting.


The Municipal Agriculture Office shall take charge in convening the gathering for purposes hereunder indicated:


7.1 Organization of the landowners, present lawful occupants of their properties, farmers and head of the family of every household;

7.2 Election of Officers;

7.3 Forging of a covenant on farm tillage among group participant themselves;


The number of officers to be elected and their respective titles shall be determined by the conveners themselves.


Section 8

DETERMINATION OF SUITABLE CROPS. The Municipal Agriculturist shall determine what kind of plant or crop suited to be planted to a particular piece or parcel of land for development. Once determined, the officer concerned shall make his recommendation to the landowner.


Section 9

SUPERVISION. The necessary supervision to help farmers achieve the success of their agricultural projects shall be provided by the staff or technical personnel of the Municipal Agriculture Office in their respective areas of coverage at the proper time under the direction of their immediate supervisor.


Section 10

DISPERSAL PROGRAM. Animal dispersal program shall be conducted periodically in barangay level by the Office of the Municipal Agriculturist in coordination with the Office of the Municipal Mayor. The dispersal may either be undertaken through distribution of pure breed sow or female livestock, natural breeding process or artificial insemination. Appropriate steps shall be taken for the success of the dispersal program.


Section 11

AVAILMENT OF SERVICES.  Any person may avail of the services of the Municipal Agriculture Office to administer artificial insemination (A.I.)  to female swine, cattle or any livestock owned by the requesting party. However, a minimal insemination fee shall be imposed, as follows:


SWINE - P100.00

GOAT -  P100.00

SHEEP - P100.00

LARGE CATTLE - P200.00


In case the insemination falls, repeat AI shall be pursued free of charges until success is attained.


Section 12

FISH CULTURE/MODERN FISHING TECHONOLOGY. Aquatic and Marine Life Culture shall be introduced for adoption in this municipality. Agri-Fishery Technologists shall conduct a periodic seminar, teach barangay residents what to do and how to manage fish culture both in fresh and seawaters, including seaweeds production. In the said seminar, marginal fisher folks shall also be taught about the utilization of modern fishing technology.


Assessment on the progress of the seminar shall be accomplished and reported in writing to the Municipal Chief Executive thru the Municipal Agriculturist, copy furnish the Sangguniang Bayan’s Committee on Agriculture.


Section 13

SEPARABILITY CLAUSE. Should any provision of this ordinance or part hereof be declared unconstitutional or invalid, the other provisions separable from the flaws shall remain in full force and effect.


Section 14

REPEALING CLAUSE. All ordinances, issuances, local laws or executive orders, inconsistent with the provision of this ordinances are hereby repealed or amended accordingly.


Section 15

EFFECTIVITY. This ordinance shall take effect immediately upon approval and after complying the publication or posting requirement as provided for under R.A. No. 7160.
