AN ORDINANCE PENALIZING ANY PERSON OR GROUP OR PERSONS OR JURIDICAL ENTITY ENGAGED IN COPRRA TRADING, WHO BUYS AND SELLS COCONUT PRODUCE, NAMELY MATURED (TIBOOK LUBI), YOUNG (BUTONG) OR COPRA, FROM ANY PERSON WITHOUT THE NECESSARY PERMIT FROM THE PUNONG BARANGAY FROM WHERE THESE COCONUTS WERE HARVESTED.
BE IT ORDAINED by the Sangguniang Bayan of Catarman, on its regular session assembled:
Section 1
TITLE. This Ordinance shall be known as “AN ORDINANCE PENALIZING ANY PERSON, GROUP OF PERSONS OR ANY JURIDICAL ENTITY, ENGAGED IN COPRA TRADING, WHO BUYS AND SELLS COCONUT PRODUCE NAMELY, MATURED (TIBUOK LUBI), YOUNG (BUTONG) OR COPRA, FROM ANY PERSON WITHOUR THE NECESSARY PERMIT FROM THE PUNONG BARANGAY WHERE THESE COCONUTS WERE HARVESTED.
Section 2
DECLARATION OF POLICY. It shall be the policy of the Municipality of Catarman, to ensure the maintenance of peace and order in the locality.
Section 3
STRICT COMPLIANCE. It is unlawful for any person or group of persons or juridical entity engaged in copra trading, to buy and sell coconut produce, namely: matured (tibuok lubi) young (butong) and /or copra, from any person without the necessary permit from the Punong Barangay from where the coconuts were/are harvested.
Section 4
PENAL CLAUSE. Any person or group of persons and/or juridical entity caught or found violating this ordinance shall be properly dealt with, with the following penalties:
4.1. 1st Offense - P750.00
4.2. 2nd Offense - P1,500.00
4.3. 3rd Offense - P2,000.00 and Revocation of business permit.
Section 5
SEPARABILITY CLAUSE. Should any provision of this ordinance or parts thereof be declared unconstitutional or found violated the other provisions separable from the flaws shall remain effective and fully operational.
Section 6
REPEALING CLAUSE. Any ordinance or any provisions hereof which are inconsistent with provisions of this ordinance are hereby repealed and/or rescinded.
Section 7
The Philippine National Police (PNP) is hereby empowered to implement this ordinance.
Section 8
EFFECTIVITY. This ordinance shall take effect upon its approval.
