1960 ORDINANCE NO. 6

AN ORDINANCE LEVYING FEES TO PEEDLERS AND MOTOR VEHICLE OPERATOR OR PROPRIETOR ENGAGE IN BUSINESS, EITHER SELL OR BARTER, WITHIN THE JURISDICTION OF THIS MUNICIPALITY.


Section 1

DEFINITION OF THE TERMS:

(a)   Peddler:

A peddler is one who goes from house to house trying to sell things. These things are commonly known is this locality as cetceriyas. This definition also includes bread, tobacco, cloths, clothes, medicine and jurdiries and other luxuries as carried on by peddlers.


(b)  Motor Vehicle Operator:

A motor vehicle operator is one who owns and operate either a truck, a car, a wagon, or a jeep engages is business of different commodities both of necessity and luxury using a truck, a car, a wagon or a jeep.


(c)   Proprietor:

A proprietor is one who holds something as an owner of commodities, both of necessity and luxury in his business enterprise, using a truck, a wagon, a car, or a jeep.


Section 2

(a) Any person or persons who engages himself or themselves in business going around this Municipality to peddle cetceriyas or bread shall pay a Municipal Fees of Five Pesos (P5.00) every quarter.


(b) Any person or persons who engages himself or themselves in business going  around this Municipality to peddle cetceriyas, bread and including tobacco shall pay a Municipal Fees of SEVEN PESOS AND FIFTY CENTAVOS (P7.50) every Quarter.


(c ) Any person or persons who engages himself or themselves in business going around this Municipality to peddle medicine only shall pay a Municipal Fees of THREE PESOS (P3.00) EVERY QUARTER.


(d ) Any person or persons who engage himself or themselves in business going around this Municipality to peddle cloths, clothes, and jewelries, shall pay a Municipal Fees of six pesos (p6.00) every quarter.


Section 3

Any operator or operators, proprietor or proprietors who engages himself or     themselves in business of different commodities within this municipality using a truck, a car, a wagon, or a jeep, shall pay a Municipal Fees of Twelve Pesos (P12.00) every quarter.


Section 4

PENALTY:

(a) Any person or persons who is/are peddling articles mentioned in Section 2, paragraphs a, b, c, and d, shall be fined of not less than Ten Pesos and not more than Thirty Pesos, or an imprisonment of not less than five Days and not more than Ten Day or both, upon the discretion of the Court.


(b) Any motor vehicle operator or operators, and any proprietor of proprietors engaging business within this Municipality found violating the herein provisions of this Ordinance, shall be fined of not less than Twenty Pesos and not more than fifty pesos or fan imprisonment of not less than Five days and not more than Twenty Days, or both, upon the discretion of the court.


Section 5

Any ordinance or parts thereof which is inconsistent to this Ordinance is hereby repealed.


Section 6

EFFECTIVITY: This Municipal Ordinance shall take effect immediately after its approval.
