1972 ORDINANCE NO. 5

AN ORDINANCE REGULATING WATER SUBSCRIBER AND THE CITIZENS IN GENERAL AND SPECIFYING THE DUTIES OF THE MUNICIPAL PLUMBER OF THE CATARMAN WATERWORKS SYSTEM.


Be It ordained by the Municipal Council of Catarman, Camiguin, assembled, that:


ARTICLE 1


NOT A MATTER OF RIGHT BUT A MATTER OF PRIVELEGE:


Section 1

To subscribe water from the Catarman Waterworks System is not a right to every citizen. It is a privilege. Therefore, the Municipal Mayor upon recommendation of the Plumber can refuse and withdraw the connection or installation of faucets anytime for cause.


Section 2

Any water subscriber who after five days having been served noticed by the Plumber that his/her faucet or faucets has mechanical defects or whose water pipes connection are already liking outside the premises of the provincial road or municipal streets, may cause closure upon order of the Municipal Mayor.


ARTICLE II


DUTIES OF MUNICIPAL PLUMBER


Section 1

The Municipal Plumber shall take charge the Catarman Waterworks System from its source down to its minutes detail provided that it is within the premises of government lot.


Section 2

His duty with respect to installation of pipes for water connection covers only up to government lot and he may be required to work in private lot provided that he will be duly paid with receipt and such payment shall accrue to the municipal government.


Section 3

He must have and hold office in the Municipal Hall and can only go outside when called for on installation of pipes for water connection, inspection, and repair of water pipes owned by the municipality.


Section 4

He can not install water connection for public and private use without previous permission from the Municipal Mayor and all necessary obligation of a person subscribing water must be previously paid.


Section 5

The Plumber shall be required to accomplish his daily  time record (C.S. Form No. 48)


Section 6

Any violation of the provisions under this article is a ground for his removal if found guilty.


ARTICLE III


Section 1

The connection of water pipes from the main line not yet reaching the Poblacion is absolutely prohibited unless necessity demands.


Section 2

Water subscriber is limited to only one connection of water pipe from the main line for every house.


Section 3

Only water pipes of one (1) inch in the diameter is accepted to be used for the connection from the main line.


Section 4

Water subscriber must see to it that their water pipe or water pipes installed and connected from the main line from any source within the premises of provincial or municipal road must be buried one (1) feet deep.


Section 5

The connection of water pipe from the main line or from any source of the waterworks system passing through or access and asphalted municipal road shall be paid by the subscribe in the amount of twenty pesos (P20.00).


Section 6

The installation of the water pipe from the main line or from any source of the waterworks system passing through or across an asphalted provincial road shall be paid by the subscriber in the amount of thirty pesos (P30.00).


Section 7

The installation of water pipe from the main line or from any source of the waterworks system passing through or across municipal road without an asphalt shall be paid by the subscriber in the amount of five pesos (P5.00).


Section 8

The installation of the water pipe from the main line or any source of the waterworks system passing through or across the provincial road without an asphalt shall be paid by the subscriber in the amount of ten pesos (P10.00).


Section 9

No faucets shall be re-opened unless previous back accounts are paid.


Section 10

Connection of bamboo pipes from the public faucets to a private lot is absolutely prohibited.


Section 11

The tampering, cutting or by any other means that may cause leakage of the pipes of the waterworks system is absolutely prohibited.


Section 12

Washing of anything in the public faucets is absolutely prohibited unless outside the ten (10) meters radios from the public faucet.


Section 13

Any person found adjusting, or tampering the seep valves without authorization from the Mayor or from the Plumber shall be penalized in accordance with the penalty innovation imposed under this article.


Section 14

Any violation of the provisions under this article shall be penalized by a fine of not more than ten pesos and not more thirty pesos, or an imprisonment of not less than five days and not more than ten days, or both fine and imprisonment at the description of the court.


Section 15

EFFECTIVITY: This ordinance shall take effect immediately upon approval.
