1975 ORDINANCE NO. 28

AN ORDINANCE TO BE KNOWN AS WATERWORKS ORDINANCE OF 1975


Be it ordained by the Municipal Council of Catarman, Camiguin, now assembled, that:


­NOT A MATTER OF RIGHT BUT A MATTER OF PREVILEGE


Section 1

The subscribe water from Catarman Waterworks System is not a right to every citizen but is only a privilege. The proper authorities concerned can refuse and withdraw the connection or installation of function any time for cause.


Section 2

It is strictly prohibited to any person to make any connection to or from the mainline of the waterworks system without due permission secured from the office of the Municipal Treasurer and concurred in by the office of the Municipal Mayor.


Section 3

It is prohibited to make connection of water pipes from the mainline not yet reaching Poblacion, except when necessity so demands and upon permission from the office of the Municipal Treasurer and concurred in by the Office of the Municipal Mayor.


Section 4

Water subscriber is limited to only one connection of water pipes from the main line for every house and only one-half (1/2) inch in diameter pipe is allowed to be used for the connection from the main line, except when a subscriber uses a mater meter, but the pipe shall not be more than one (1) inch in diameter.


Section 5

Water subscriber making connection of water pipes from the main line and passing through the street or road to his house must bury the pipes one foot deep to avoid disruption of traffic and pedestrians.


Section 6

Installation or connection of water pipes from the main line or from any source of the waterworks system passing any asphalted road or street, the subscriber must pay the amount of thirty pesos to the office of the Municipal Treasurer before crossing the said road of street.


Section 7

Installation or connection of water pipes from the main line or from any source of the waterworks system passing to street or road not asphalted, the subscriber must pay the amount of ten pesos to the office of the Municipal Treasurer before passing or crossing the street or road.


Section 8

When a connection is cut-off and the subscriber may so desire to re-open his/her connection, said subscriber must first settle his/her back account if any before the re-opening of new connection.


Section 9

No bamboo connection is allowed from public faucet to a private lot.


Section 10

Tampering cutting or by any other means that may leakage or disruption of water flow from the pipes is prohibited.


Section 11

Washing of anything in the public faucet is prohibited unless outside the tenth meter radius from the public faucet.


ARTICLE II

THE PLUMBER AND ITS DUTIES


Section 1

A plumber is a person employed by the Municipal Mayor with proper appointment who shall take charge of the waterworks system, from its source down to its minutes details provided that it is within the premises of government lot.


Section 2

His duty with respect to installation of pipes for water connection covers only up to government lot and he maybe required to work in private lot provided that he will be duly paid with receipt and such payment shall accrue to the Municipal Government, on the bases of eight pesos a day of actual work.


Section 3

He must not install water connection for public or private use without previous permission from the Municipal Treasurer and concurred in by the Municipal Mayor.


Section 4

He must have and hold office in the office of the Municipal Treasurer and shall be required to accomplish his daily time record and can only go outside the office when called for on installation of pipes for water connection, or inspection, and or repair of water pipes owned by the municipality.


Section 5

Any violation of the provisions under this article is a ground for his removal if found guilty.


ARTICLE III

MODE OF PAYMENT­


Section 1

A water subscriber must pay three pesos a month of his water connection from the mainline, and for every additional connection from the main line, one peso each.


Section 2

At the option of the subscriber, payment may be made either every month, every quarter, or every year.


Section 3

PENALTY: Any person or persons found violating the provisions of this ordinance under Articles I and III shall be penalized by a fine of not less than fifty pesos and not more than one hundred pesos or by imprisonment of not less than ten days and not more than twenty days, or both fine and imprisonment at the discretion of the court.


Section 4

Effectivity:  This ordinance shall take effect on January 1, 1976.
