1985 ORDINANCE NO. 8

BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF CATARMAN, CAMIGUIN that:


Section 1

This Ordinance shall be known as:

As Ordinance imposing license fee for establishing and maintenance of Fish Shelter (“Payao”) within the Municipal waters of Catarman, Camiguin.


Section 2

Words and/or terms used in this ordinance shall mean:

              

a) Fish shelter or payao refer to bamboos, logs, barrels and other like materials bundled together, placed and anchored within the territorial waters of the Municipality of Catarman intended to provide habitat for fish.

b) Municipal waters of Catarman refers to the entire area from the coastline extending up to 3 nautical mills to the high seas and as provided for under the Sec. 21 (a) f the Local Taxation Code.

c) Operators refers to individual association, partnership or corporation who maintained fish shelters or payao.


Section 3

No person, association, partnership or corporation shall establish and maintain fish shelter (Payao) within the municiapal waters of Catarman without first securing a license and pay the corresponding permit fee as provided for under the next subsequent section.


Section 4

Operators of fish shelters (Payao) shall be before anchoring their payaos within the municipal waters of Catarman pay the following license fees:


a) Fish shelter with the size of less than ten (10) square meters shall pay a license fee of One Hundred Pesos (P100.00) per year.

b) Fish shelter with the size of 10 sq,m, not more than 20 sq.m. shall pay a license fee of Two Hundred Pesos (P200.00) per year.


Section 5

Subsistence fishermen from the municipality of Catarman who wish and are actually operating with hook and line near within the vicinity of the fish shelter shall in no case be prohibited for the operators and be permitted to fish free of charge or fee.


Section 6

Other ordinances with provisions contrary to the provision of this ordinance shall be deemed amended and/or repealed.


Section 7

Violation of any of the provision of this ordinance shall be fined by not less than Five Hundred Pesos (P500.00) not more than One Thousand Pesos (P1,000.00) or imprisonment for not less than one (1) month not more than six (6) months or both at the discretion of the court.


Section 8

This ordinance shall take effect 15 days after its approval.
