    1997 ORDINANCE NO. 5

    ORDINANCE DECLARING THE STO. NIÑO COLD SPRING RESORT AS AN ECONOMIC ENTERPRISE AND PRESCRIBING OPERATIONAL RULES AND REGULATIONS THEREOF AND FOR OTHER PURPOSES.


    Section 1

    This Ordinance shall be known as the Ordinance declaring the Sto. Niño Cold Spring Resort as an Economic Enterprise and prescribing operational rules and regulations thereof and for other purposes.


    Section 2

    Coverage. This ordinance shall cover all the operation procedure in the use and maintenance of Sto. Niño Cold Spring Resort and the prescription of fees to all users of the facilities within the Sto. Niño Cold Spring Resort.


    Section 3

    Purpose. This Ordinance is enacted to support the policy of making the Sto. Niño Cold Spring Resort an economic enterprise of the municipality.


    Section 4

    Goal. This Ordinance is enacted to support the regulation of the use of natural resources enhancing the ecological balance within the Sto. Niño cold Spring Resort thereby promoting the clean and green program of the government, maintain the natural scenery and tourism development of the municipality.


    Section 5

    Operation.


    a) All persons entering in the Sto. Niño Cold Spring Resort from ages seven (7) years old and above shall be allowed only after paying the entrance fee prescribed by this Ordinance.

    b) The Executive House, the SP cottage, the main cottage and the picnic sheds shall only be occupied by persons upon payment of fee prescribed by this Ordinance.

    c) The Municipal Mayor shall designate Operation Manager to oversee the operation on the Sto. Niño Cold Spring Resort.


    Section 6

    Business establishment.


    a) The Municipal Government through the Operation Manager may run a restaurant business in the Main Cottage which shall be under the supervision of the Operation Manager.

    b) This restaurant business shall cater to the food needs or visitors who enter the resort and to seminars conducted in the resort.

    c) Private persons or entitles who wish to enter business within the resort shall be allowed only upon presentation of business proposal subject to the approval of the Municipal Mayor upon authority issued by the Sangguniang Bayan.

    d) All consigned item for sales in the restaurant shall have the following mark-up:


    1. For items whose unit value are worth P100.00 or above shall bear a mark-up of 20%: and

    2. For items whose unit value are worth P100.00 below shall bear a mark-up of 10%.




    Section 7

    Revenues.


    a) All revenue earned in the operation of the Resort shall be entrusted to the Municipal Treasurer.

    b) All revenue earned in the operation of the Resort shall be used solely for the operation and maintenance of the Resort.


    Section 8

    Fees.


    a) There shall be collected from any person of ages seven and/or above entering in the Resort the following entrance fees:


    1. Fifteen years old and below ……………………. P 5.00

    2. Sixteen years old and below …………………… P 10.00

    3. Senior Citizens (sixty years old and above) ….. P 8.00


    b) There shall be collected from any visitor or group of visitors who use the picnic shed the amount of P 35.00 for the whole day.

    c) There shall be collected from any visitor who uses the Executive and SP Cottage the following rate:


    a) Room Service - P350.00/day

    b) Entire cottage occupancy

    1. Executive cottage - P 900.00/day

    2. SP cottage - P 700.00/day

    c) Use of extra facilities/services

    1. Use of extra folding bed

    With sheet and pillow - P40.00/day/person

    2. Use of convenience outlet for radio

    Or cassette tape recorder at

    Picnic shed - P30.00/day/outlet

    3. Use of ground space for tent - P15.00/sqm/day

    4. Room service pay - 10% of order worth

    5. Use of table (open) - P20.00/day

    d) Use of Main Cottage for seminar - P1,000.00/day


    Section 9

    Training/seminar venue.


    a) The Main cottage shall be used when a private or government entity conducts a seminar.

    b) The Operation Manager shall be responsible for the facilitation of the seminar and shall provide the necessary requirements/facilities in the conduct of the said seminar.

    c) The Operation Manager is hereby authorized to enter into bidding of seminar which price he shall determine as competitive and beneficial to the Resort.

    d) Contract or Service order of the seminar shall be finally approved by the Municipal Mayor.


    Section 10

    Funding Requirement.


    a) The Municipal Government in its annual preparation of the Municipal Budget shall allocate funding for the operation and maintenance of the Resort as an economic enterprise.

    b) It shall further allocate in the Municipal Budget an operational fund (seed fund) for the operation of the restaurant and conduct of seminars.

    c) The Municipal Treasurer shall allocate a petty cash of P2,000.to the Operation Manager subject to auditing and accounting rules and regulations.


    Section 11

    Responsibility to the visitors.


    1. It shall be known that the safety of all visitors in the Resort is the responsibility of the Municipal Government of Catarman.


    Section 12

    Share of Revenue


    1. The Municipal Government shall provide a share of One percent (1%) of gross entrance receipts of the Resort to the Barangay of Sto. Niño.

    2. Share of the barangay shall be remitted every quarter of the year.


    Section 13

    Prohibition.


    a) There shall be no person who use the facility(ies) of the Resort without paying the prescribed fees set forth in this Ordinance.

    b) No visitor is allowed to throw away any trash like cigarette butts, candy wrappers, food left-overs and others except in the trashcan provided within the vicinity.

    c) No person will be allowed to act or display any indecent act within the vicinity of the Resort.

    d) No drunkard is allowed to enter the Resort.

    e) No person with visible skin disease is allowed to enter the vicinity of the Resort.

    f)  No person is allowed to use bathing soap, wash clothes wash food utensils or display any unhygienic practices within the waters of the resort.


    Section 14

    Penalties.


    a) Any person caught in violation of this Ordinance shall be subjected to the following:


    1. First offense a fine of P50.00

    2. Second offense a fine of P1,000.00

    3. Third offense a fine of P2,500.00

    or imprisonment of Thirty (30) days or both upon the discretion of the court.


    Section 13

    Repealing Clause.


    Any approved ordinance in whole or part thereof inconsistent with the provisions of this Ordinance is hereby deemed repealed revoked and superseded.


    Section 14

    Effectivity Clause.


    This Ordinance shall take effect upon approval.
