2010 ORDINANCE NO. 2

AN ORDINANCE CREATING AND HOLDING A MARKET DAY AND NIGHT CAFE ON SEPTEMBER 18, 2010, AND EVERY SATURDAY THEREAFTER AT THE MUNICIPAL PLAZA IN THE MUNICIPALITY OF CATARMAN, PROVINCE OF CAMIGUIN.


BE IT ORDAINED by the Sangguniang Bayan of this Local Government Unit in regular session assembled:


Section 1

TITLE. This legislative enactment shall be known and cited to as Market Day and Night Cafe Ordinance.


Section 2

DECLARATION OF POLICY. The following shall be declared to be among the policies of this Municipality:

2.1 Encourage farmers to plant more agricultural crops in order to yield an abundant harvest;

2.2 Teach jobless residents how to be productive and learn to earn for their sustainable daily bread requirements;

2.3 Let investors, merchants, traders and other business personalities participate activity in the Market Day and Night Cafe buy displaying for sale their merchandise, goods, articles and other items as their contribution to our quest for economic growth; and

2.4 To endeavor to be self-reliant in all aspects of development.


Section 3

VENUE. The Market Day and Night Cafe shall be held at the Municipal Plaza of this municipality every Saturday, commencing on September 18, 2010. In case of rain, the municipal gymnasium shall be utilized as substitute venue of the affairs, subject however to the approval of the Municipal Mayor.


Section 4

TIME DURATION. The duration of the Market Day is from 7:00 o’clock in the morning to 6:00 o’clock in the evening and thereafter the Night Cafe follows to start at 6:30 in the evening and to close at 12:00 o’clock midnight in every designated day.


Section 5

DESIGNATION OF DISPLAY AREA. The Municipal Mayor is given blanket authority to designate and specify the exact location and display area for every barangay.


Section 6

DISPLAY STRUCTURE. Booths, stall, and other temporary structures where farm products, commodities, articles and/or other items are to be displayed for sale shall be provided for by the Municipal Government concerned.


Section 7

PROHIBITED GOODS. Goods, merchandise commodities, articles or items which are prohibited and therefore not within the lawful commerce of man are strictly not allowed to be displayed for sale during the Market Day and Night Cafe, or on any place and any time within our territorial jurisdiction whether in the open market or clandestinely.


Section 8

PROCUREMENT, All Barangays Chairman (Captains) and Members of the Sangguniang Barangays, this municipality, shall be responsible in the procurement of agricultural products for display and for sale in their respective booths or stalls during the Market Day.


Section 9

TAX HOLIDAY. All businessmen or investors, merchants, traders, vendors, and business enthusiasts who are displaying for sale any articles, agricultural products, and/or foodstuffs on the occasions of the Market Day and Night Cafe Fairs shall enjoy four (4) Saturdays Tax Holiday as their incentives. The four (4) Saturdays are as follows: September 18, September 25, October 2 and October 9, all in 2010, and every third Saturday of September of every year. Thereafter the collection of tax, through the issuance of cash tickets or any other mode of collection, shall be enforced.


Section 10

KARAOKE BAR. Karaoke Bar and/or Sing-along session shall be permitted to operate during the Night Cafe, provided that at 10:00 o’clock in the evening the sound of the karaoke music shall be regulated to a moderate level in such a way that it will not provoke anger to nearby residents. Certain areas for smoking within the venue of the Night Cafe shall be provided, as chosen by the Municipal Mayor.


Section 11

POLICE VISIBILITY. The visibility of Peace Officers in the area of the Market Day and Night Cafe venue shall be made available by the Local Philippine National Police operatives and the Barangay Tanods of Poblacion to maintain peace and order thereat from the start of the affair until the closing hour of the business.


Section 12

SANITATION. Both and/or stall occupants are mandated to observe proper sanitation on their respective display area by providing their own trash cans and see to it that their surroundings are always clean from the start of the business in the morning until the close of business hour in the evening during the Market Day and Night Cafe.


Section 13

CLOSURE OF STREETS. The Fausto Dugenio Street and the First Sangguniang Bayan Street. From the National Highway up to Zenon Murillo Street shall be closed to traffic every Market day and Night Cafe affairs.


Section 14

SEPARABILITY CLAUSE. Should any provision of this ordinance or part hereof be declared unconstitutional or invalid, the other provisions separable from the flaws shall remain valid and enforceable.


Section 15

REPEALING CLAUSE.  All ordinances, issuances, local laws and/or executive orders which are inconsistent with the provisions of this ordinance are hereby repealed or amended accordingly.


Section 16

EFFECTIVITY.  This ordinance shall take effect immediately upon approval and after complying the publication or posting requirements pursuant to Republic Act No. 7160.
