2011 ORDINANCE NO. 3

AN ORDINANCE VENTURING AND INVESTMENT IN THE MANGO PRODUCTION PROJECT OF VARIOUS MANGO GROWERS IN THE MUNICIPALITY OF CATARMAN, PROVINCE OF CAMIGUIN, AS PART OF ITS ECONOMIC ENTERPRISE AND FOR OTHER PURPOSES.


BE IT ORDAINED by the Sangguniang Bayan of this municipality, in regular session assembled:


Section 1

TITLE. This legislative measure shall be known and cited to as an investment Ordinance.


Section 2

DECLARATION OF POLICY. It is hereby  declared to be among the policies of this Local Government Unit to generate more income, create job opportunities, and support the project of the private sectors to make it visible.


Section 3

DEFINITION OF TERMS. Unless the context otherwise indicates, the following shall be construed to mean:

3.1 Investment - taking part in the mango production project by pouring financial capital for the procurement of sprayers chemicals (fruit inducer, insecticide, fungicide, and others) and the hiring of the work force to do the spraying and caring of the healthy growth of the fruits;

3.2 Mango Growers - those who plant mango seedlings, take good care of the plants until the same are fully grown up to its productive stage;

3.3 Sharing System - it’s the procedure of dividing the total harvest of the mango fruits between the investor and the mango growers concerned;

3.4 MOA - refers to the Memorandum of Agreement.


Section 4

EXECUTION OF THE MOA. The memorandum of Agreement shall be entered into by and between the herein investor to be represented by the Honorable Nestor A. Jacot, Municipal Mayor, of LGU-Catarman, Camiguin, and the Mango Growers concerned, which MOA shall provide the terms and conditions that must be strictly complied with by agreeing parties.


Section 5

The LGU as an investor shall provide its own sprayer, purchase chemicals, insecticide, fungicide and hire the workforce to perform the spraying of the said chemicals to induce the fruiting of mango trees, and take good care of the young fruits, maintain its growth, keep it healthier until harvest time, as similarly defined under investment hereinabove.


Section 6

MANAGEMENT. The Municipal Agriculture Office shall be given full responsibility in the management of the aforesaid investment project, which include among others as follows:


6.1 Conduct proper training to the hired and/or the recruited labor force about the effective spraying of chemicals to mango trees (fruit, inducing, caring, keeping its healthy growth, wrapping of the fruits, until the same are harvested);

6.2 Determine the number of the workforce to be hired;

6.3 Estimate the needed financial capital for the project, and other incidental task and/or requirements to make the investment project a success;


Section 7

CAPITALIZATION SOURCE. The needed financial capital for the investment shall be taken from any savings in every department of this Local Government Unit, which shall be appropriated for the purpose above stated in a Supplemental Budget.


Section 8

DISBURSEMENT OF EXPENSES. All disbursement relative hereto shall be subject to accounting and auditing scrutiny, pursuant to their usual practices and procedure.


Section 9

SHARING SYSTEM. The total harvest of the mango fruits covered by this investment project shall be divided by three (3) in the following manner:

9.1 Two (2) shares for the investor, and

9.2 One (1) share for the Mango Grower


Section 10

CONTROL AND SUPERVISION. This investment project of the Local Government shall be under the control and supervision of the Municipal Mayor, inclusive of the hiring and/or tthe recruitment of the labor force.


Section 11

SEPARABILITY CLAUSE. Should any provision of this Ordinance or parts hereof be declared unconstitutional or invalid, the other provisions separable from the flaws shall remain in full force and valid.


Section 12

REAPELING CLAUSE. All ordinances, issuances, local laws or executive orders inconsistent with the provisions of this ordinance are hereby repealed or amended accordingly.


Section 13

EFFECTIVITY. This ordinance shall take effect immediately upon approval and after complying the publications and posting requirements as provided for under Republic Act No. 7160.
