AN ORDINANCE PROVIDING A DONATION BOX AND PLACE IT AT THE MOST STRATEGIC AND CONSPICUOUS LOCATION OPPOSITE A GIGANTIC CROSS, A LANDMARK SYMBOLIZING THE PRESENCE AND INCLUSION OR AN AREA OF THE HISTORIC SUNKEN CEMETERY SITUATED AT BONBON, CATARMAN, CAMIGUIN.
BE IT ORDAINED by the Sangguniang Bayan, this municipality, in its regular session, the following:
Section 1
TITLE . This peace of legislation shall be known and cited to as an ORDINANCE MANDATING THE PLACEMENT OF A DONATION BOX AT THE MOST AND CONSPICUOUS LOCATION OPPOSITE A GIGANTIC CROSS, STANDING OFFSHORE AT THE SUNKEN CEMETERY OF THE AFOREMENTIONED BARANGAY.
Section 2
PURPOSE. The objective of this measures is for the improvement of the Sunken Cemetery and other related tourism projects.
Section 3
OPENING OF THE DONATION BOX. One month after the installation of the Donation Box and monthly thereafter, or at anytime to be determined by the Caretaker, the box shall be opened and the cash amount dropped therein properly accounted for by the Municipal Treasurer or her duly authorized representative in the presence of the Chairman of the Committee on Tourism of the Sangguniang Bayan concerned and the caretakers of the donation box. The Municipal Mayor shall be furnished with any pertinent paper or document showing the amount of donation money properly accounted. This document receipt or voucher must be duly certified and authenticated by the Municipal Treasurer or her authorized representative by affixing her or his signature thereon and this must be done weekly corresponding to the frequencies of box disclosure.
Section 4
The proceeds of the cash donation shall be placed in the special accounts of the LGU concerned and these special accounts shall be maintained in the general fund for proper disbursement.
Section 5
DESIGNATION OF CARETAKERS. This Municipal Mayor shall designate or appoint caretakers to oversee the Donation Box everyday on rotation basis.
Section 6
The caretaker shall be responsible in keeping safely the Donation Box and the cash amount contain therein and shall put up a Surety Bond in the amount to be determined by the Municipal Treasurer, and approved by the Local Chief Executive, to secure the payment in case of loss of the cash amount in the donation box.
Section 7
SHARING SCHEME. That Barangay Bonbon, through its Barangay Treasurer, shall receive Ten (10%) Percent of the total net income, as its share, every time the donation box is opened and the money contained therein properly accounted for, and Ninety (90%) Percent of the net proceeds of which goes to the Municipal Government of Catarman, through its Municipal Treasurer.
Section 8
PENALTY CLAUSE. Any person caught or found tampering, looting or stealing the money inside the Donation Box, shall be penalized by a fine not exceeding Five Thousand (P5,000.00) Pesos, or an imprisonment not exceeding One (1) month or both fine and imprisonment, at the discretion of the court.
Section 9
SEPARABILITY CLAUSE. Should any provision of this ordinance or portion thereof be declared unconstitutional or not valid, the other provisions separable from the flaws shall remain effective and in full force.
Section 10
EFFECTIVITY. This Ordinance shall take effect immediately after complying with the publication or posting requirement, pursuant to Republic Act No. 7160, otherwise known as the Local Government Code of 1991.
