AN ORDINANCE ESTABLISHING STANDARD ELEVATION OF TWENTY FEET HIGH ABOVE THE GROUND LEVEL ON ANY AERIAL INSTALLATION SUCH AS ELECTRICAL WIRE, TELEPHONE LINE OR ANY OTHER SIMILAR MATERIAL FOR ANY LAWFUL PURPOSE, STRETCHING MOSTLY FROM THE POST OR ANY HIGH OBJECT ACROSS ANY ROAD, STREET, OR TRAIL UP TO THE DESIRED END, AND PROVIDING PENALTY THEREOF.

Be it ordained by the Sangguniang Bayan of the Municipality of Catarman, Island Province of Camiguin in regular session assembled.

Section 1

Title - This measure shall be known and referred to as an ordinance establishing standard elevation of twenty one (21) feet above the ground level on any aerial installation like electrical wire, telephone line, or any other similar material across any street, road, or trail up t the desired end.

Section 2

Declaration of Policy – It is hereby declared that among the policies of this local government unit is to take good care on Public Safety.

Section 3

Definition of terms - Unless the context otherwise indicates, the following shall be construed to mean:

3.1  Standard elevation  - Uniformity of the height of Twenty (20) Feet high above the ground level on any aerial installation like electrical wire, telephone line and/or any similar material stretching across any street, road or trail towards the desired end.

3.2  Installation – In so far as this ordinance is concerned, installation shall mean the tapping or connecting of an electrical wire, telephone line or any other similar material mostly stretching from the post or any elevated object towards the other end.

3.3  Stretching - A display of any wire, line, string or bunting parallel to the level from where it originated until it reaches to a desired end.

Section 4

The height of Twenty (20) Feet above the ground level on any of the said aerial installation shall be maintained from where it is tapped stretching up to the other end.

Section 5

Strict Compliance – Ay person natural or juridical installing electrical connection or telephone lines, including other aerial installation across any road or trail shall strictly comply the standard elevation of Twenty (20) Feet high from the ground level as herein referred to above.

Section 6

Penal Clause. – Any person, natural or juridical, caught or found violating this ordinance, shall be properly dealt with in accordance with the following graduated penalty:

Section 7

Separability Clause – Should any provision of this ordinance or part thereof be declared unconstitutional or found violative of any provision of the National Law, the other provision separable from the flaws shall remain effective and fully operational.

Section 8

Reapeling Clause - Ordinances, issuances, local laws and/or executive orders which are inconsistent with the provisions of this ordinance, are hereby repealed or amended, accordingly.

Section 9

Effectivity. - This ordinance shall take effect immediately after complying the publication or posting requirement, pursuant to Republic Act No. 7160 otherwise known as the Local Government Code of 1991.
