AN ORDINANCE KNOWN AS THE BARANGAY MICRO BUSINESS ENTERPRISE (BMBE) IN THE MUNICIPALITY OF CATARMAN, CAMIGUIN.
Section 1
TITLE. This Ordinance shall be known as the Enabling Ordinance for the implementation of R.A. 9178.
Section 2
REGISTRATION. There shall be a registration of Barangay Micro Business Enterprise (BMBEs) with principal place of business in the municipality and consequent issuance of Certificate of Authority to enable the BMBE to avail of the incentives under R.A. 9178.
Section 3
WHO MAY REGISTER. Any person, natural or juridical, cooperative or association, having the following qualifications, may apply for registration as BMBE.
3.1 with an asset size of not more than Three Million (P3,000,000.00) Pesos excluding land before applying for BMBE registration; and
3.2 engaged in the business activities as defined in Section 3(a) of R.A. 9178;
Section 4
BMBE ACTION PANEL. For efficient registration of BMBEs there shall be created a BMBE Action Panel composed of the following:
Chairman : Municipal Treasurer
Vice-Chairman : Municipal Assessor
Members : Municipal Accountant
Municipal Budget Officer
Municipal Planning & Development Coordinator
Municipal Engineer
DTI Representative
The Panel may invite the other government agencies and private organizations which will greatly contribute to the advancement of the objectives setforth by the Action Panel.
Section 5
PANEL FUNCTIONS. The Action Panel shall have the following functions:
5.1 to receive an evaluate BMBE application and recommend the approval and acceptance thereof by the Office of the Municipal Mayor;
5.2 to coordinate with different government agencies such as the Bureau of Internal Revenue, department of Trade & Industry, the Department of Science and Technology. University of the Philippines Institute of Small Scale Industries, Cooperative Development Authority and the Technology and Livelihood Resource Center for technology transfers, production and management training and marketing assistance to BMBEs;
5.3 To coordinate with government financial institutions such as Land Bank of the Philippines, Development Bank of the Philippines, Small Business Guarantee and Finance Corporation and Peoples Credit and Finance Corporation and such other financial institution for direct and indirect financing for BMBEs:
5.4 to implement public information and educational campaigns coordinating with the Philippine Information Agency, Department of Labor and Employment and Department of the Interior and Local Government, to ensure proper and adequate information dissemination to the public especially the beneficiaries in the barangay level.
Section 6
SECRETARIAT. The Action Panel shall be assisted by the Assistant Municipal Treasurer, if appointed. A full time Secretariat thereof shall be formed under the supervision of the Action Panel which shall be tasked to receive and process application and releases of the Certificate of Authority to qualified applicants.
Section 7
REGISTRATION PROCEDURES. The following are the procedures when applying for registration as BMBE:
7.1 An applicant for BMBE shall accomplish BMBE Form 01 in triplicate copies and submit the same to the Secretariat;
7.2 The Office of the Municipal Treasurer upon recommendation of the Action Panel shall evaluate the same within fifteen (15) working days upon receipt of complete documents. Otherwise the BMBE shall be deemed registered; and
7.3 The Municipal Treasurer shall issue Certificate of Authority to a registered BMBE as proof of registration.
The certificate of Authority shall be effective for a period of two (2) years, renewable every two (2) years thereafter.
Section 8
TRANSFER OF OWNERSHIP. The BMBE shall report to the Office of the Municipal Treasurer of any change in the status of its ownership structure and shall surrender the original copy of the BMBE Certificate of Authority for notation of the transfer.
Section 9
APPLICATION FEE. There is hereby imposed and collected by the Municipal Treasurer an application fee of Two Hundred (P200.00) Pesos from every applicant for BMBE registration upon submission of the application to defray expenses for the cost of registering and monitoring BMBEs.
Section 10
EFFECTIVITY. This Ordinance shall take effect upon its approval.
