1964 Ordinance No. 4

AN ORDINANCE AMENDING ORDINANCE NO.8, SERIES OF 1961, RETRUCKLOAD FEES OF SAND, GRAVELS AND/OR STONES HAULED OR TRANSPORTED FROM THE UNPROHIBITED SHORELINE OR ELSEWHERE OF CATARMAN, CAMIGUIN SUBPROVINCE, MISAMIS ORIENTAL.


Section 1

Any person, operator or truck owner who shall haul or transport sand, gravels and or stones from the unprohibited shoreline or elsewhere of this municipality shall first secure permit from the Office of the Mayor.


Section 2

Any permit that shall be issued by the Office of the Mayor shall state the exact number of cubic meters of sand, gravels and/or stones to be hauled or transported from the unprohibited shoreline or elsewhere of the municipality.


Section 3

The Municipal Treasurer upon presentation to him of the permit issued by the Office of the Mayor shall require the person, operator, or truck owner to pay the amount of TWENTY-FIVE CENTAVOS (P0.25) per cubic meter per haul which shall go to the General Fund, instead of One Peso (p1.00) per cubic meter per haul charged in Section 3 of Municipal Ordinance No. 8, Series of 1961.


Section 4

The sand, gravels, and/or stones to be hauled or transported from the unprohibited shoreline or elsewhere of this municipality which are to be used by the Highway District Engineer of Camiguin Subprovince for any national or Provincial projects, provided that it is not under any construct to haul or transport by any private person, operator, or truck owner which shall be subject to the provisions of Section 3 above, shall be secure permit from the Office of the Mayor although no fee shall be charged thereto.


Section 5

Any person, operator, or truck owner granted the permit to haul or transport sand, gravels and /or stones hall report to the Police Guard every time sand, gravels, and/or stones are hauled or transported by him.


Section 6

PENALTY – Any person, operator or truck owner found violating any part of the provisions of this Ordinance shall be fined the amount of not less than Twenty-Five Pesos (P25.00) nor more than Fifty Pesos (P50.00), of an imprisonment of not less than ten (10) days nor more than twenty (20) days, or both fine and imprisonment at the discretion of the court.


Section 7

REPEALLING CLAUSE – Any ordinance or parts thereof which are inconsistent with any of the provisions of the Ordinance are hereby repealed.


Section 8

EFFECTIVITY – This ordinance shall take effect immediately upon its approval.
