2005 ORDINANCE NO. 6

AN ORDINANCE REGULATING THE SOLID WASTE MANAGEMENT AND DISPOSAL IN THE MUNICIPALITY OF CATARMAN, CAMIGUIN.


Section 1

TITLE. This ordinance shall be known as “The Solid Waste Ordinance of 2005.


Section 2

DEFINITION OF TERMS. The following terms and phrases used in this ordinance shall mean as follows:


A. Solid Waste shall include the following:

A.1 According to Source:

A1.1. Household solid waste/garbage

A1.2. Hospital/medical solid waste

A1.3. Industrial solid waste

A1.4. Solid waste of business establishments, markets, schools, parks and plaza and government institution, etc.


A2. According to Classification:

A2.1. Non-biodegradable – wastes like plastics, bottles, tires, cellophane, Styrofoam and like wastes that are not capable to decay.

A2.2. Biodegradable – wastes that easily decay and turn into soil like papers, grass cutting leaves, branches and other agricultural waste etc.

A2.3  Recyclable Solid Waste – wastes which can be recycled for other use, like bottles, can containers, plastic containers, woods, metals, etc.


B. Households solid wastes are domestic wastes produced under normal condition by each and every households, like kitchen wastes, garden cuttings, plastic & paper wrappers, etc.


C. Hospital/Medical Wastes – are those produced by hospital, health centers, clinics and the like. Some of those are toxic and hazardous.


D. Industrial wastes are those produced by industrial establishments, which may include poisonous and hazardous materials used in their line of industry. Small industrial outfits are likewise producing industrial wastes like unused tires, rust, unused parts metals in case of repair shop, “tinabas” in case of a tailoring, sawdust in case of a furniture shop, and sawmill rice and corn brain in case of a miller and others.


E. Solid waste of business establishments, etc – refers to cartoons, paper wrappers, plastics, unused woods and boards and even cut grasses and branches of trees.


F. Market waste may include parts of the damaged stock in trade plastic and paper wrappers. Cartoons, cellophane, etc.


Section 3

POLICY STATEMENTS. It is the primary trust of the Municipality of Catarman to provide utmost sanitation and maintain fair ecosystem, maintain environmental integrity, protect the people from the hazard of diseases, provide a place that is healthful, clean and socially well provided community. It is the policy of the LGU to maintain the management system and disposal strategies of the solid waste produced in the Municipality of Catarman, Camiguin.


Section 4

PROHIBITIONS. The following acts and practices are prohibited under this ordinance:


A. For all concerned to dispose of, throw out and/or dump solid wastes at any place not so designated as such by the LGU.

B. For all concerned to dispose of, throw out and/or dump solid wastes including solid waste carcasses or dead animals in all rivers, springs, water shed areas, creeks, beaches, open field, within the municipal waters of Catarman. In no case shall the disposal and dumping be permitted in the above areas.

C. To dispose of solid wastes by burning in violation of the Clean Air Act of 1996.

D. In no case shall solid wastes coming from other municipality be permitted to be dumped within the jurisdiction of Catarman.


Section 5

DUTIES AND RESPONSIBILITIES:

              

A. Household

A1. It shall be the duty and responsibility of the head on the household to see to it that its domestic solid wastes is managed in accordance with the provision of this ordinance.

A2. It shall be the duty and responsibility of each and every household in the Municipality of Catarman to:

A2.1 Provide three-(3) color-coded solid waste containers, red for non-biodegradable wastes, green for recyclable/reusable wastes and white for biodegradable wastes.

A2.2 Segregate and classify the solid wastes it domestically produced and put theme in the containers as provided for by the preceding, sub-paragraph. A compost pit within its vicinity which shall be used to dispose of its biodegradable solid wastes, like grass cutting, leaves, branches, papers, cartoons and the like. The solid wastes on its containers segregated in accordance with the provisions of this ordinance at a designated place for the barangay to pick up and deposit at the designated areas.


B. Educational Institution

B1. It shall be the duty and responsibility of the principal, school in charge or the administrator to see to it that this ordinance shall be implemented within its school campus.

B2. It shall be the duty and responsibility of all educational institution operating within the Municipality of Catarman to:

B2.1 Provide color coded trash cans or its equivalent, red for non-biodegradable, green for recyclable/reusable and white for biodegradable solid wastes in every school room for the segregation and classification of the solid waste they produced.

B2.2 Provide a compost pit, 5 x 5 x 1 in size within its school ground where the school can deposit its biodegradable solid wastes.

B3. To place the containers of its non-biodegradable and recyclable/reusable solid wastes at a designated place for the barangay to pick up and deposit at a designated garbage collection center.


C.  Hospitals, Clinics and Health Centers:

C1. It shall be the duty and responsibility of the administrators of hospitals, medical clinics and health centers to manage their medical waste considered toxic and hazardous in accordance to the existing rules and regulations. It is likewise the duty and responsibility of the administrator of said institution to manage the disposition of its domestic solid wastes not classified as toxic and hazardous in accordance with the provision of this ordinance.

C2. It shall be the duty and responsibility of all hospitals, medical clinics and health centers to:

C2.1 Provide three (3) color-coded containers, red for non-biodegradable, green for recyclable/reusable and white for biodegradable solid wastes.

C2.2 Segregate and classify the solid wastes it produced in accordance to the provisions of the preceding sub-paragraph.

C2.3 Provide a compost pit, 2 x 2 x 1 in size within its vicinity where it could deposit its biodegradable solid wastes.

C2.4 To place its non-biodegradable wastes in its proper containers at the designated area for the barangay to collect and deposit at the garbage collection center at scheduled time.


D. Market & LGU Enterprises:


D1. It shall be the duty and responsibility of the administrators of the Market and other LGU enterprises to see to it that the management and disposal of the solid wastes it produced shall be in accordance with the provisions of this ordinance.


E. Barangay:

E1. It shall be the duty and responsibility of the Punong Barangay to ensure that the provisions of this ordinance shall be strictly implemented.

E2. It shall be the duty of the barangay to provide a garbage collection center within its area of responsibility where the sorting and classification of solid wastes shall be made.

E3. It shall be the duty and responsibility of the barangay to collect all the solid wastes produced by each and every household, school, business and industrial enterprises, parks, plazas, streets, tourist spots, beaches and others and to deposit the same in a designated collection area.

E4. It shall be the duty and responsibility of the barangay to provide the required compost pit where the biodegradable wastes shall be deposited and left to decay.


F.  Municipal Government/Local Government Unit (LGU)

F1. It shall be the duty and responsibility of the LGU to:

F1.1 Collect the garbage produced by the barangay business establishments, industrial enterprises, hospitals and clinics, parks, plazas, beaches, LGU enterprises, market and the like and bring the same to the LGU garbage collection center sorting it into non-biodegradable, biodegradable and recyclable/reusable wastes and further to set the collection schedule for each barangay and other areas.

F1.2 To make if it warrants the solid wastes which could be marketed.

F1.3 To provide a dumpsite for biodegradable wastes where the garbage shall be deposited and left to decay.


Section 6

PENALTY.

              

A. Any person violating the provisions of this ordinance shall be penalized and fined as follows:

A1. Offense – Fines and Penalties

A1.1 First Offense  -   P200.00 and 2 days imprisonment

Second Offense -  P500.00 and 6 days imprisonment

Third Offense  - P1,000 and 10 days imprisonment

                      

All at the discretion of the court.


Provided further that if the offender is a juridical person, the President or Manager in case of a corporation, the managing partner is case of a partnership and the President or Manager in case of a cooperative shall be held liable for this violation.


B. Any person dumping solid wastes coming from other municipalities shall be fined by P2,500.00 plus imprisonment of one (1) year, at the discretion of the court.


Section 7

For the purpose of implementing the provisions of this ordinance the Honorable Mayor may appoint an Action Officer enjoying his trust and confidence.


Section 8

REPEALING CLAUSE. All other local legislation, orders, circulars and/or memorandum, which provisions read counter to this ordinance are deemed repealed and/or modified.


Section 9

SEPARABILITY CLAUSE. If for any reason part of this ordinance is declared unconstitutional the other parts not affected shall remain enforceable and effective.


Section 10

EFFECTIVITY. This ordinance shall take effect upon its approval and satisfaction of other requirements as provided for by law.
