AN ORDINANCE PROHIBITING ANY PERSON OR PERSONS TO CATCH FISH BY WAY OF FENCING (SAGUP) THE DINANGASAN RIVER OF THIS MUNICIPALITY THEREBY CHANGING THE COURSE OF THE FLOW OF SAID RIVER AND, THEREFORE, SHALL ENDAGNER THE LIVES AND PROPERTIES OF THE INAHBITANTS OF THE BARRIOS OF LILOAN AND LOOC, THIS MUNICIPALITY, AND PROVIDING PENALTIES THEREFORE.
Be it ordained by the Municipal Council of Catarman, Camiguin Sunprovince, Misamis Oriental, that:
Section 1
Any person or persons are prohibited to catch fish or fishes by way of fencing (sagup) the Diangasan River of this Municipality thereby changing the course of the flow of the said river and, therefore, shall endanger the lives and properties of the inhabitants of the Barrios of Liloan and Looc, this municipality.
Section 2
PENALTIES: Any person or persons found violating any provisions of this ordinance shall be punished by an imprisonment of not less than 30 days nor more than 60 days, or a fine of not less than P30.00 nor more than P100.00, or both at the discretion of the court.
Section 3
SUBSIDIARY IMPRISONMENT: Those who cannot pay the fine imposed by the court shall suffer subsidiary imprisonment of P2.50 per day to cover said fine.
Section 4
REPEALING CLAUSE: Any ordinance the provisions of which are inconsistent with the provisions f this ordinance are hereby repealed.
Section 5
EFFECTIVITY: This ordinance shall take effect immediately upon its approval.
