1994 ORDINANCE NO. 4a

AN ORDINANCE DECLARING THE MUNICIPAL MARINE WATERS OF CATARMAN TO BE RESERVED FOR THE EXCLUSIVE USE OF THE FISHERIES OF CATARMAN AND/OR THEIR ASSOCIATIONS, PARTNERSHIPS, CORPORATIONS OR COOPERATIVES, WHO ARE RESIDENTS HEREAT TO CATCH FISH WITHIN A DISTANCE OF FIFTEEN (15) KILOMETERS FROM THHE SHORELINE OF THIS MUNICIPALITY.


Section 1

This ordinance shall be known as Fishing Ordinance of Catarman for 1994.


Section 2

The municipal waters of Catarman is exclusively reserved for the use of the local fishermen of Catarman and/or their associations, partnerships, corporations or cooperatives, who are residents of the Municipality of Catarman, to catch fish within a distance of fifteen (15) kilometers from the shoreline of this municipality.


Section 3

As used in this ordinance, the terms are defined as follows:


a) Municipal Marine Waters include between two lines drawn perpendicularly to the general coastline from points where the boundary lines of the municipality touch the sea at low tide and third line parallel with the general coastline and fifteen (15) kilometers from it.

b)    Residents refer to, in the case of natural persons, one who must have reside in the Municipality of Catarman.


Section 4

Notwithstanding Section 2 of this ordinance to the contrary this Body may grant special permit to any fishermen, association, partnership, corporation or cooperative, who are residents of the adjacent municipalities of the province of Camiguin, to catch fish within the Municipal waters of Catarman, Camiguin, to catch fish within the Municipal waters of Catarman, after securing clearance papers from the Municipal Agriculturist with the approval of the Mayor, and to any government research and educational institutions to catch fish or take fish or aquatic life using any fishing gear only for scientific and educational purposes, subject to such terms and conditions this Body may deem proper to impose.


Section 5

Violation of this ordinance shall subject the offender to a fine of not exceeding Two Thousand Five Hundred (P2,500.00) Pesos, or an imprisonment for a period not exceeding six (6) moths, or both, at the discretion of the court, and confiscation of the fishing gear and paraphernalia.


Section 6

All existing ordinances and resolutions of parts thereof inconsistent with the provisions of this ordinance are hereby repealed and/or rescinded.


Section 7

This ordinance shall take effect immediately upon its approval.
