1995 ORDINANCE NO. 1

BE IT ORDAINED by the Sangguniang Bayan of Catarman, Camiguin, in its regular session the following:


AN ORDINANCE DECLARING THE MUNICIPAL WATERS OF CATARMAN, CAMIGUIN, TO BE RESERVED FOR THE PREFERENTIAL USE OF THE BONAFIDE RESIDENTS FISHERMEN OF CATARMAN AND ITS NEIGHBORING MUNICIPALITIES OF SAGAY, GUINSILIBAN, MAHINOG AND MAMBAJAO, CAMIGUIN, AND/OR THEIR ASSOCIATIONS, PARTNERSHIPS, CORPORATIONS OF COOPERATIVES, TO CATCH FISH WITHIN A DISTANCE OF FIFTEEN (15) KILOMETERS FROM THE SHORELINE OF THIS MUNICIPALITY.


Section 1

This ordinance shall be known as Fishing Ordinance of Catarman of 1995.


Section 2

The municipal waters of Catarman shall be reserved for the preferential use of the bonafide residents fishermen of Catarman and its neighboring municipalities of Sagay, Guinsiliban, Mahinog and Mambajao, Camiguin, and/or their associations, partnerships, corporations or cooperatives, to catch fish within a distance of fifteen (15) kilometers from the shoreline of this municipality.


Section 3

As used in this ordinance, the terms are defined as follows:


a) Municipal marine waters include between two lines drawn perpendicularly to the general coastline from points where the boundary lines of the municipality touch the sea at low tide and third line parallel with the general coastline and fifteen (15) kilometers from it.

b) Bonafide residents refers to, in the case of natural persons, one who must have resided in the municipality of Catarman and its neighboring municipalities of Sagay, Guinsiliban, Mahinog and Mambajao, (for a period of at least five (5) years, from the date of the application for fishing permit, and must also be a registered voters thereof) and as to the associations, partnerships, corporations or cooperatives, the principal place of business of which must be in the Municipality of Catarman and its said neighboring municipalities, and the members of the fishermen crew of the fishing boats must all be bonafide residents of Catarman and its neighboring municipalities of Camiguin (for a period of at least five (5) years, from the date of the application for fishing permit, and must also be a registered voters thereof).


Section 4

Unless the requirements stated in paragraph (b) of Section 3 hereof are complied with, no permit/license shall be issued to any person, natural or juridical, to operate within the municipal waters of this municipality.


Section 5

Notwithstanding Section 2 of this ordinance to the contrary, a special permit may be granted to any government research and educational institutions to catch fish or take fish or aquatic life using any fishing gear only for scientific and educational purposes.


Section 6

Violation of this ordinance shall subject the offender to a fine of not exceeding Two Thousand Five Hundred Pesos (P2,500.00), or an imprisonment for a period not exceeding six months (6), or both, at the discretion of the court, and confiscation of the fishing gear and paraphernalia.


Section 7

All existing ordinances and resolution or parts thereof inconsistent with the provisions of this ordinance are hereby repealed and/or rescinded.


Section 8

This ordinance shall take effect immediately upon its approval.
