1996 ORDINANCE NO. 2

AN ORDINANCE DECLARING THE MUNICIPAL MARINE WATERS OF CATARMAN, CAMIGUIN, TO BE RESERVED FOR THE PREFERENTIAL USE OF THE BONAFIDE RESIDENTS FISHERMEN OF CATARMAN AND ITS NEIGHBORING MUNICIPALITIES OF SAGAY, GUINSILIBAN, MAHINOG AND MAMBAJAO AND THEIR ASSOCIATIONS, PARTNERSHIPS, CORPORATIONS OR COOPERATIVES OPERATING WITHIN THE PROVINCE OF CAMIGUIIN, TO CATCH FISH WITHIN A DISTANCE OF FIFTEEN (15) KILOMETERS FROM THE SHORELINE OF THIS MUNICIPALITY.


BE IT ORDAINED by the Sangguniang Bayan at Catarman, Camiguin, in its regular session, the above-entitled ordinance:


Section 1

This ordinance shall be known as fishing Ordinance of 1996.


Section 2

The municipal marine waters of Catarman, Camiguin, shall be deserved for this preferential use of the bonafide residents of Catarman and its neighboring municipalities of Sagay, Guinsiliban, Mahinog and Mambajao, Camiguin, and their associations, partnerships. Corporations or cooperatives operating within the Province of Camiguin, to catch fish within a distance of fifteen (15) kilometers from the shoreline of this municipality.


Section 3

As used in this ordinance, the terms are defined as follows:


a) Municipal marine waters include between two lines drawn perpendicularly to the general coastline from points where the boundary lines of the municipality touch the sea at low tide and third line parallel with the general coastline and fifteen (15) kilometers from it.


b) Bonafide residents fishermen refer to, in the case of natural person, one who must have actually and physically resided in the municipality of

Catarman and its neighboring municipalities of Sagay, Guinsiliban, Mahinog and Mambajao, Camiguin, and their associations, partnerships, corporations or cooperatives operating within the Province of Camiguin, to catch fish within a distance of fifteen (15) kilometers from the shoreline of this municipality.


Section 3

As used in this ordinance, the terms are defined as follows:

b) Bonafide residents fishermen refer to, in the case of natural person, one who must have actually and physically resided in the municipality of Catarman and it neighboring municipalities of Sagay, Guinsiliban, Mahinog and Mambajao, for a period of two (2) years from the date of the application for fishing permit, and as to associations, partnerships, corporation or cooperatives, the principal place of business of which must be in the municipality of Catarman and its said neighboring municipalities, and its incorporators, board of directors or officers, members, operators, managers, arise and other members of the fishing crew of the fishing boats must all be bonafide residents, as herein defined, of Catarman and its said neighboring municipalities for a period of two (2) years from the date of the application for fishing permit.


Section 4

Unless the requirements stated in paragraph (b) of Section 3 hereof are complied with, no permit/license shall be issued to any person natural or juridical, to operate within the municipal waters of the municipality.


Section 5

Notwithstanding Section 2 of this ordinance to the contrary, a special permit may be granted to any government research and educational institutions to catch fish or take fish or aquatic life using any fishing gear only for scientific and educational purposes.


Section 6

Violation of this ordinance shall subject the offender to a fine or not less than Two Thousand Five Hundred (P2,500.00) Pesos, or an imprisonment for a period of not less than six (6) months, or both, at the discretion of the court, and confiscation of fishing gear, paraphernalia and fishing boat(s).


Section 7

All existing ordinance/resolutions or parts thereof inconsistent with the provisions of this ordinance ate hereby repealed and/or rescinded.


Section 8

This ordinance shall take effect immediately upon its approval.
