    1966 ORDINANCE NO. 3

    AN ORDINANCE REQUIRING ALL HEADS OF FAMILIES AND OWNERS OF BUSINESS ESTABLISHMENTS WITHIN THE JURISDICTION OF THIS MUNICIPALITY TO INSTALL A SANITARY TYPE OF TOILET AND PROVIDING PENALTIES FOR VIOLATORS THEREOF.


    Be it ordained by the Municipal Council of Catarman, Camiguin Subprovince, Misamis Oriental, that:

                  

    Section 1

    The Definition of Terms: SANITARY: within the meaning of this ordinance is defined to mean the physical condition of living and/or working quarters which will tend to prevent the incidence and spread of disease. SANITARY TYPE OF TOILET refers only to toilets with water-sealed bowls (local made) and the standard flush system. SHALL – where “shall” is used a provision specified hereinafter, that provision is intended to be mandatory.


    Section 2

    All dwelling places, business establishment places for public use shall be provided with a sanitary type of toilet except those that are located within public markets wherein the Municipal Government shall provide and maintain adequate toilet facilities which are separate for each sex.


    Section 3

    It shall be unlawful for a person or persons of legal age to occupy a new house or building for dwelling and/or working purposes, without a PERMIT and/ or CERTIFICATE OF OCCUPANCY obtained from the Municipal Health Officer stating, among other things, that said house or building has been provided with a sanitary type of toilet and is fit for dwelling and/or working purposes.


    Section 4

    PENAL PROVISIONS: Any person or persons who shall violate any provision of this ordinance, shall upon conviction, be fined the amount of not less than Ten Pesos (P10.00) for the FIRST OFFENSE; Twenty Pesos (P20.00) and/or an imprisonment of not more than Ten (10) days, at the discretion of the court, for the SECOND OFFENSE; and One Hundred Pesos (P100.00) and/or imprisonment of not more Thirty (30) days, at the discretion of the court, for the THIRD OFFENSE and/or the subsequent offense thereafter.


    Section 5

    Any ordinance inconsistent with the provisions of this ordinance is hereby repealed.


    Section 6

    EFFECTIVITY: This ordinance shall take effect TEN (10) days after its approval.
