1980 ORDINANCE NO. 12

AN ORDINANCE REPEALING ORDINANCE NO. 7, SERIES OF 1983, KNOW AS MUNICIPAL MARKET ORDINANCE.


Section 1

Any occupant/occupants shall comply with the following requirements in the Office of the Municipal Treasurer before they be issued clearances in the offices concerned, to wit:


a) Mayor’s business permit shall be paid in the amount of P10.00 per annum, without prejudice to adjust the rate depending upon the income of the occupant for the year. Such permit shall be secured from the Office of the Mayor.

b) Mayor’s clearance shall be paid in the amount of P5.00 per annum, to be secured from the Office of the Mayor.

c) Judge’s clearance shall be paid in the amount of P5.00 per annum such permit shall be secured in the office of the Circuit Judge, Circuit Court;

d) Police clearance shall be paid in the amount of P5.00 per annum and secured from the Office of the station Commander of the PC/INP.

e) Treasurer’s clearance shall be paid in the amount of P5.00 per annum, such clearance shall be secured from the office of the Municipal Treasurer.

f) Sanitary permit shall be paid in the amount of P5.00 per annum, such permit shall be secured from the Office of the Rural Health Physician or his duly authorized representative.

g)     Carenderia operators shall pay P5.00 per quarter.


Section 2

If the Carenderia operators have sari-sari stores and retail liquors, they must pay P5.00 per sari-sari every quarter; for liquors, at P7.50 every quarter at the office of the Municipal Treasurer or his duly authorized representative.


Section 3

SANITATION. All market vendor/vendors and/or room occupants must observe cleanliness, to wit:

a) Must have a broom and garbage can of his/her own.

b) Must clean his/her immediate surroundings

c) Must provide his/her own sanitary devices to protect cooked foods from flies.

d) Must not maintain dogs, pigs, goats, fowls and other live animals within the premises of the market.

e) Must not maintain fighting cocks in the market room.

f)  Must not dump waste materials in the brook at the side of the market

g) Must not clean animal’s internal organs within the market premises.

h) Must not spit on the cement fiber

i)  Must provide hot water always for making used utensils

j)  The slaughter of animals, slicing of fish, beef, pork and similar kinds of clean shall be done in the slaughtering house provided for.

k) Users of tables in the fish and meat section must clean them after using.

l)  Market vendor/vendors and/or market occupants shall wear neat dresses, and/or shall maintain pleasant personality.


Section 4

Display of drying of clothes, garments, diapers, mats and mattresses and other things not intended for sale is strictly prohibited within the market premises.

Section 5. No member of the family of an occupant of a room who is sick is allowed to stay in the market room.


Section 6

All market occupants of room are required to furnish costumers with clean cloth dish towel.


Section 7

No occupant/occupants is/are allowed to sleep in the market room and/or on the table during night time.


Section 8

Market vendors having both sari-sari stores and carenderia shall provide their own fire extinguisher and other paraphernalia, such as empty can of petroleum, ax. Hammer, ready for use in case of fire within the market, premises.


Section 9

The Room:


a) Only one room shall be granted to an occupant/occupants.

b) No person/persons is/are allowed to occupy the market room who are members of the same family or those related within the third degree wither of consanguinity or of affinity;

c) No adjoining occupants are allowed to remove the partition that separates their room so as to appear as one room.

d) No occupant of the is allowed to assign or sell his/her right to the room to anybody. If an occupant with to give-up his/her business, he/she should return the room to the Municipal Treasurer .

e) An occupant who shall vacate his/her room is prohibited to remove or detach any attachment in the room without the consent of the Municipal Treasurer and approved by the Municipal Mayor

f) Room rental must be in the amount of P70.00 per month and he/she pay in advance for one month payable in the office of the Municipal Treasurer.

g) Upon failure of an occupant of a room to pay his/her rental on the fifth day of the month, he/she is given a grease period of fifteen days within which to pay the delinquency; if he still

fails to pay the delinquency, his/her right to use and enjoy the room is ipse facto cancelled and shall vacate the room.

h) Any improvement introduced by an occupant, he shall seek first clearance from the Office of the Municipal Mayor.


Section 10

No occupant/occupants is/are allowed to make his/her own dirty kitchen in the market room they can seek by the use of shellane, gas-stove or gas range.


Section 11

Any market vendor/vendors and/or occupants who violate the provisions of this Ordinance is ground for cancellation of the permit.


Section 12

Any ordinance whose provision or provisions is/are inconsistent with this Ordinance is hereby repealed.


Section 13

This ordinance shall take effect immediately.
