1984 ORDINANCE NO. 8

“AN ORDINANCE REVISING ORDINANCE NO. 7, SERIES OF 1964, DATED JUNE 6, 1964, THIS MUNICIPALITY OTHERWISE KNOWN AS AN “ORDINANCE PENALIZING PERSONS IN STATE OF INTOXICATION FOUND IN AND ROAMING ABOUT PUBLIC PLACES, AND PERSONS GIVING AND/OR SELLING INTOXICATING LIQUOR MINORS UNDER 18 YEARS OF AGE.”


BE IT ORDAINED BY THE SB OF CATARMAN, CAMIGUIN THAT:


Section 1

This ordinance shall be known as the ordinance regulating the sale and drinking of intoxicating liquor in this municipality;


Section 2

It shall be unlawful:


a) For any person or group of persons engaged n the sale of intoxicating wines, such as Gin, Rhum, whiskey or any kind of drinks of the same nature and effect or fermented liquors, like beer, tuba, or any beverages that cause intoxication, serve of permit any person to drink the aforementioned wines and fermented liquors in his establishment:

b) For any storeowner, dealer or any other person to sell, give or offer any kind of intoxicating beverages or liquors in his establishment:

c) For any person to drink intoxicating beverages or liquids in any street, parks, theaters or cinematograph building or in any other public place or any store not lawfully authorized or licensed to serve liquors or beverages or any kind of drinks; except that the serving and drinking of intoxicating liquor in public buildings or public places on occasion of legitimate parties, gatherings, banquets and the like, shall be allowed only upon prior permission from the Office of the Chief of Police, this municipality;

d) For any storeowner of dealer to serve or permit or allow any person to drink intoxicating beverages of liquids in his establishments or premise if said storeowner or dealer is not licensed or authorized to serve said drinks;

e) For any person who is intoxicated or under the influence of liquor to such a degree that he may be capable of causing disturbance pr breach of peace or bodily injury or damage to persons or property to be in/or to roam about the public streets, parks, markets, restaurants or any other public places;


Section 3

All authorized or licensed storeowner and dealer of intoxicating beverages and liquids or establishments engaged in the sale of wines and fermented liquors or storeowners or dealers not lawfully authorized to serve these drinks in their establishment shall be required to post notices or posters to inform all customers about the prohibition in this ordinance regarding the sale of intoxicating drinks. Incompliance there with, shall be sufficient ground to cancel his corresponding license;


Section 4

Any person violating this ordinance shall:


a) Be fined by not less than P100.00 for the first offense;

b) Be fined by not less than P200.00 for the second offense;

c) Be fined by not less than P300.00 for the third offense; and

d) Be fined by not less than P300.00 and an imprisonment of not less than 15 days for the fourth and succeeding offenses;


Section 5

All ordinances inconsistent with this ordinance are hereby repealed


Section 6

This ordinance shall take effect 15 days after its approval.
