2012 ORDINANCE NO. 5 (Centennial Memorabilia)

AN ORDINANCE DECLARING AS UNLAWFUL THE REMOVAL, TAMPERING AND/OR DESTROYING OF THE CENTENNIAL MEMORABILIA MARKER WHEREON THE NAMES OF THE ELECTIVE MUNICIPAL AND SOME PROVINCIAL OFFICIALS, CATARMAN & CAMIGUIN, RESPECTIVELY, WERE ENGRAVED AND PERMANENTLY ENSHRINED AND FIXED AT THE FOOT OF THE FLAGPOLE SITUATED OPPOSITE THE 1967 MUNICIPAL HALL OF THIS MUNICIPALITY.


BE IT ORDAINED by the Sangguniang Bayan of Catarman, Island Province of Camiguin, in its regular session, assembled:


Section 1

TITLE – This legislative enactment shall be known and referred to as an Ordinance declaring as unlawful, the removal, tampering and/or destroying of the Centennial Memorabilia Marker, permanently fixed at the foot of the flagpole, situated opposite the 1967 Municipal Hall.


Section 2

DECLARATION OF POLICY  - It is hereby declared to be the policy of this municipality, among others, the preservation of the historical marker, installed/enshrined at any public place.


Section 3

DEFINITION OF TERMS - Unless the context otherwise indicates, the following shall be construed, to wit:


3.1 Memorabilia  - Things that are remarkable and worthy of remembrance;

3.2 Tampering  - Refers to altering for an improper purpose;

3.3 Juridical Person – A being of legal existence, susceptible of rights and obligations, or of being Subject of juridical relation;

3.4 Natural Person - Refers to a human being.


Section 4

UNLAWFUL ACT - Removal, tampering and/or destroying of any historical and valuable memorab ilia, like the Centennial Marker properly installed as mentioned above, is hereby declared as unlawful act.


Section 5

RESTORATION OF A DESTROYED AND/OR REMOVED CENTENNIAL SILVER METAL MARKER - Any person who remove and/or destroy the permanently fixed Centennial Silver Metal Marker, aforementioned, shall restore the same in its original form at the place where it was permanently fixed.


Section 6

PENALTY CLAUSE. Any person, juridical or natural found tampering. Destroying and/or removing the Centennial Marker explicity mentioned above shall be penalized by a fine not exceeding Two Thousand Five Hundred (P2,500.00) Pesos or an imprisonment for a period not more than Six (6) months, or both in the discretion of the court.


Section 7

SEPARABILITY CLAUSE. Should any provision of this ordinance or parts thereof be declared unconstitutional or violation of the national statute, the other provisions separable from the flaws shall remain effective and in full force.


Section 8

REPEALING CLAUSE. All ordinances, issuances, local laws and/or Executive Orders, inconsistent with the provisions of this ordinance are hereby repealed or amended accordingly.


Section 9

EFFECTIVITY. This ordinance shall take effect immediately upon approval and after complying the publication or posting requirement as provided for under R.A. No. 7160.
