2012 ORDINANCE NO. 5 (Crossing Police Line)

AN ORDINANCE PENALIZING ANY PERSON WHO SHALL CROSS OR BREACH A POLICE LINE/CORDON IN THE MUNICIPALITY OF CATARMAN AND PROVIDING PENALTY THEREOF.


BE IT ORDAINED by the Sangguniang Bayan, this municipality, in its regular session the following:


Section 1

TITLE. This measure shall be known and referred to as an ordinance penalizing any person who shall cross or breach a police line/cordon in the Municipality of Catarman, Camiguin.


Section 2

DECLARATION OF POLICY. It is hereby declared that among the policies of this local government unit is to take into consideration first and foremost the safety of the general public in times of crisis.


Section 3

DEFINITION OF TERMS - Unless the context otherwise indicates, the following shall be construed to mean:


Police Line or Cordon  - it is a demarcation line which is drawn or made by law enforcement officers involved in a legitimate on-the-scene crime or fire investigation or response, which purpose is to prevent bystanders or other individuals not involved in such operations, response, investigation or from getting near or proximate to the crime or fire scene. It is usually, but not necessarily indicated by a yellow strip of clothing or other materials which bears the words “POLICE LINE, DO NOT CROSS.”


Section 4

Any person shall be prohibited to cross or breach any police line/cordon in the Municipality of Catarman, Camiguin.


Section 5

PENALTY CLAUSE. Any person violating this ordinance shall be dealt with a fine of Two Thousand Five Hundred (P2,500.00) Pesos or imprisonment of fifteen (15) days or both such fine and imprisonment at the discretion of the court.


Section 6

SEPARABILITY CLAUSE. Should any provision of this ordinance or parts thereof be declared unconstitutional or found in violation of any provision of the national law. The other provisions separable from the flaws shall remain effective and fully operational.


Section 7

REPEALING CLAUSE. Ordinances, issuances, local laws and/or executive orders which are inconsistent with the provisions of this ordinance, are hereby repealed, amended accordingly.


Section 8

This ordinance shall take effect immediately after complying the publication or posting requirement, pursuant to RA7160, otherwise known as the Local Government Code of 1991.
