1973 ORDINANCE NO. 7 (Amendment)

Be it ordained by the Municipal Council of Catarman, Camiguin, Philippines, now assembled, that:


ARTICLE I


BUSINESS PERMIT


Section 1

Only the office of the Municipal Mayor shall issue business permit.


Section 2

An applicant for business permit to engage in business in the public market shall present to the Municipal Secretary who shall prepare the permit the following:


(a)  Clearance from the Office of the Municipal Judge.

(b)  Clearance from the Office of the Chief of Police

(c)  Clearance from the Office of the Municipal Treasurer

(d)  Health Certificate from the Rural Health Physician, and in his/her absence from his/her authorized representative.


Section 3

The fees per clearance and or the health certificate is two pesos each to be paid in the Office of the Municipal Treasurer.


Section 4

The business fee in two pesos, to be paid in the office of the Municipal Treasurer.


ARTICLE II


SANITATION


Section 1

All market vendors and or room occupants must observed cleanliness.


(a)  Must have a broom and garbage can or box of his/her own

(b)  Must clean his/her immediate surroundings.

(c)  Must provide his/her own sanitary device to protect cock foods from flies

(d)  Must not maintain dog, raise dog pig, goat, fowls and other live materials within the premises of the market

(e)  Must not maintain fighting cock in the market room

(f)   Must not dumped waste materials in the brook at the side of the market

(g)  Must not split on the cement floor

(h)  Must not clean animal internal organs within the market premises

(i)   Must provide hot water always for washing used utensils

(j)   The slaughter of animals, slicing of fish, beef, pork and similar kind of flesh shall be done in the slaughter house provided for.

(k)  Users of tables in the fish and meat section must clean the tables after using it.


Section 2

Deliveries of infants by the mothers in the market room is prohibited.


Section 3

Display or drying of clothes, garments, diaphers, mats and mattresses, and other things not for sale is prohibited within the market premises.


Section 4

No member of the family of an occupant of a room who is sick allowed to stay in the market room. Market room must not be used as residential place of the occupant.


Section 5

All market occupants of rooms are required to furnish customers clean dish towels.


ARTICLE III


SAFETY


Section 1

Market vendor having a booth-store, sari-sari store or carenderias shall provide his/her own fire extinguisher and other fire paraphernalias, such as opened can of pretrolium, an ax, hammer, ladder, etc, ready for use in case of fire may brake within the market premises.


ARTICLE IV


THE ROOM


Section 1

Only one room shall be granted to an applicant.


Section 2

No adjoining occupants are allowed to agree to remove the partition that separates their room so as to appear as one room.


Section 3

No occupant if a room is allowed to assign, or sell his/her room to anybody. If an occupant wish to give-up his/her business, should return the room to the Municipal Treasurer.


Section 4

An occupant who shall vacate his/her room is prohibited to remove or detach any attachment in the room without the consent of the Municipal Treasurer and approval by the Municipal Mayor.


Section 5

The rental of room are as follows:


1) The room along the Pelaez Street is P240.00 per annum

2) The room at the other extreme end of the market near the fish and meat section is P240.00 per annum for the first floor and P120.00 per annum for the second floor.

3) All other room in between the two extreme shall pay rental of Ph180.00 per annum.

4) That this provision in section 5 shall take effect on January 1, 1976.


Section 6

The rental or room for the month of January of each year shall be paid in full and the succeeding payments shall be paid on or before the fifth day of each month.


Section 7

Upon failure of an occupant of room to pay his/her rental on the fifth day of the month is given a grace period up to the end of that month, and if still fails to pay, his/her right to use and enjoy the room is motto propio cancelled and shall vacate the room.


ARTICLE V


PENALTY


Section 1

Failure to comply with the provisions of this ordinance is a ground for the cancellation of the permit.


ARTICLE VI


REPEALING CLAUSE


Section 1

Any ordinance whose provision or provisions is/are inconsistent with the provisions of this ordinance is hereby repealed.


ARTICLE VII


EFFECTIVITY


Section 1

This ordinance shall take effect on January 1, 1974.
