AN ORDINANCE PENALIZING ANY DRIVER OR MOTORELA, TRICYCLE AND MOTORCYCLE FOR HIRE “HABAL-HABAL” CARRYING OR TRANSPORTING COPRA, COCONUTS AND “BUCO” WITHOUT NECESSARY PERMITS SECURED BY THE COCONUT OWNERS FROM THE PUNONG BARANGAY WHERE SAID COCONUTS WERE HARVESTED.

BE IT ORDAINED by the Sangguniang Bayan, this municipality, on its regular session assembled:

Section 1

TITLE. This ordinance shall be known as an “ORDINANCE PENALIZING ANY DRIVER OF MOTORELA, TRICYCLE AND MOTORCYCLE FOR HIRE “HABAL-HABAL” CARRYING OR TRANSPORTING COPRA, COCONUTS AND “BUCO” WITHOUT NECESSARY PERMITS SECURED BY THE COCONUT OWNERS FROM THE PUNONG BARANGAY WHERE SAID COCONUTS WERE HARVESTED”.

Section 2

STRICT COMPLIANCE. It shall be unlawful for any driver of motorela, tricycle and motorcycle for hire “habal-habal” to carry and transport coconut products without the owner’s permit of such product from the Punong Barangay to ensure that the coconuts are not stolen.

Section 3

PENALTY CLAUSE. Any person/driver found to have violated the provisions of this ordinance shall be penalized accordingly:

3.1 1st Offense - impoundment of vehicle at the PNP Station, to be released upon payment of P1,000.00 fine at the Office of the Municipal Treasurer.

3.2 2nd Offense - impoundment of vehicle at the PNP Station to be released upon payment of P1,500.00 fine at the Office of the Municipal Treasurer.

3.3 3rd Offense - impoundment of vehicle at the PNP Station, to be released upon payment of P2,000.00 fine at the Office of the Municipal Treasurer.

Section 4

The Philippine National Police (PNP) and the Punong Barangay are hereby empowered to implement this ordinance.

Section 5

The PNP has the authority to seize and impound the driver’s vehicle if found not having the necessary permit from product owners.

Section 6

REPEALING CLAUSE. Any ordinance or any provisions hereof which are inconsistent with provisions of this ordinance are hereby repealed and/or rescinded.

Section 7

SEPARABILITY CLAUSE. If for any reason or reasons, any part of this ordinance is held unlawful or invalid, other parts and provisions hereof which are not affected thereby shall continue to be in full force and in effect.

Section 8

EFFECTIVITY. This ordinance shall take effect upon its approval.
