1996 ORDINANCE NO. 3

“AN ORDINANCE IMPOSING FEES ON LICENSE TO FISHING OPERATION/ACTIVITY AND FEES ON RESALE OF FISH CATCH GRANTED TO BONAFIDE RESIDENTS FISHERMEN OF CATARMAN AND ITS NEIGHBORING MUNICIPALITIES OF SAGAY, GUINSILIBAN, MAHINOG AND MAMBAJAO, CAMIGUIN.”


BE IT ORDAINED by the Sangguniang Bayan of Catarman, Camiguin, in its special session, the above-captioned ordinances:


Section 1

This ordinance shall be known as Special Fees on fishing within the municipal marine waters of Catarman.


Section 2

Bonafide residents fishermen, who resided in the municipality of Catarman, and its neighboring municipalities of Sagay, Guinsiliban Mahinog and Mambajao, for a period of two years, shall secure Mayor’s Business Permit, license to operate and clearances prescribed in this ordinance or  before the 15th day of January of every year.


Section 3

The Mayor’s permit and license to operate fishing vessels within the municipal marine waters of Catarman Shall be valid for one year in which they are issued.


Section 4

The schedule of fees for license to operate fishing vessel within the municipal marine waters of Catarman shall be:


TYPE OF FISHING VESSELS       AMOUNT


1.      Licom-licom               -       P1,000.00/annum

2.      Launch                      -        2,000.00/annum

3.      Palaran                      -       125.00/quarter


Section 5

a) Cash tickets for resale of fish catch shall be collected at P20.00 per box.

               

b) This include all fish catch by licensed operators sold to buyers (comprador) where transactions are consummated elsewhere in the municipality whether in land or in sea.


c) This includes fish catch by operators and sold by themselves.


d) For paragraph b in this section, cash tickets shall be collected from the buyers (comprador): and


e) For paragraph c in the section, cash tickets shall be collected from the operators themselves.


Section 6

All fish buyers (comprador) transacting business within the municipality shall secure mayor.s business permit.


Section 7

For the security of the municipality, all buyers (comprador) of fish transacting business in this municipality shall secure clearance from the local police before any permit shall be granted. As such, all vessels used to load boxes of fish shall be registered, including the names of persons operating the said vessels, at the Office of the Local Police.


Section 9

Penalty Clause. Any person, each member of the association, partnership, corporation of cooperative found violating any provision of this ordinance shall be fined of not less than two thousand five hundred (P2,500.00) pesos, or an imprisonment for a period of not less than six (6) months, or both, and confiscation of fishing gears, paraphernalia, including the impounding of the fishing vessels used.


Section 10

Repealing Clause. Any ordinance or parts thereof inconsistent with the provisions of this ordinance are hereby repealed.


Section 11

Effectivity, This ordinance shall take effect upon its approval.
