2003 ORDINANCE NO. 1

AN ORDINANCE REGULATING THE OPERATIONS OF SINGLE MOTORCYCLES AS PASSENGER CARRIER IN THE MUNICIPALITY OF CATARMAN, CAMIGUIN.

 

BE IT ORDAINED by the Sangguniang Bayan of Catarman, Camiguin in its regular session:

 

Section 1

This Ordinance shall be known as the “SINGLE MOTORCYLCE PASSENGER CONVEYANCE ORDINANCE OF 2003.

 

Section 2

For the purpose of this Ordinance, the power and duties of the Motorized Tricycle Operators Board (MTOB) is deemed expanded specifically, the MTOB shall issue separate Implementing Rules and Regulations (IRR) to regulate the operations of Single Motorcycle Passenger Carrier embodying the provisions of this Ordinance and other rules, regulations and issuances which the MTOB may deem to have suppletory effect.

 

Section 3

The operation of sing motorcycle conveyance as passenger carrier is hereby regulated in this municipality in the manner herein prescribed.

 

3.1  All single motorcycle conveyance as passenger carrier shall first be duly registered and insured in accordance with the rules and regulations of the Land Transportation Office. 

3.2  All single motorcycles conveyance, as passenger carrier shall then secure Permit to Operate from the Municipal Government, through the MTOB of this municipality, according to the following rates:

 

Permit to Operate           P 160.00 renewable

Mayor’s Permit                   50.00/annum

Health Clearance               20.00/annum

Police Clearance                30.00/annum

 

3.3  The MTOB shall upon issuance of the Permit to Operate inspect the single motorcycle conveyance as passenger carrier to be provided among other additional gadgets such as but not limited to crash guards, footrests and cargo loaders.

 

Section 4

Driver of this single motorcycle conveyance as passenger carrier must possess Professional Driver’s License.

 

Section 5

Single motorcycle conveyance as passenger carrier shall be covered with insurance good for two (2) passengers in addition to the Driver and the unit itself.

 

Section 6

These single motorcycle conveyance as passenger carrier are intended to service upland sitios and barangays. Henceforth, the MTOB is empowered to prescribed from time to time specific traffic routes necessary utilizing alternate highways, if available. Likewise, the MTOB shall approve the prescribed transport rates to specific upland far flung sitios/puroks of the different barangays of this municipality subject to consultations with the Liga ng mga Barangay. Operators and Drivers of the single motorcycle for passenger conveyance.

 

Section 7

Operators and Drivers of single motorcycle conveyance as passenger carrier shall provide themselves and their passengers with crash helmets for their own safety.

 

Section 8

The MTOB shall specifically assign case numbers for every approved permit to operate holders and shall require these holders to mark said case numbers to their units being operated.

 

Section 9

Penalty Clause. Violation of any provision of this Ordinance shall be subjected to the following:

 

FIRST OFFENCE                                                                 A fine of P500.00

SECOND OFFENCE                                                          A fine of P1,000.00

THIRD AND SUCCEEDING OFFENSE                  Revocation of PERMIT TO OPERATE

 

Section 10

Separability Clause. Should any portion of this Ordinance be declared invalid, all other portion hereof not affected thereby remain valid and in force.

 

Section 11

Repealing Clause.  All ordinances or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed.

 

Section 12

Effectivity. This ordinance shall take effect upon approval and posting thereafter in conspicuous places in this municipality.
