    1992 ORDINANCE NO. 2

    AN ORDINANCE REGULATING AND IMPOSING FEES RELATIVE TO TRISIKAD OPERATIONS IN THIS MUNICIPALITY.


    Section 1

    This ordinance shall be known as Trisikad Operation Ordinance of 1992.


    Section 2

    Trisikad operators are required to register their trisikad units, and to pay a registration fee in the amount of sixty (P60.00) pesos per unit annually, at the Office of the Municipal Treasurer.


    Section 3

    There shall be another imposition in the amount of twenty (P20.00) pesos as Mayor’s Business Permit in addition to the necessary clearances per trisikad operator annually, at the Office of the Municipal Treasurer.


    Section 4

    It is prohibited to allow minors below eighteen (18) years old to drive these trisikads.


    Section 5

    Any person is prohibited to drive the trisikad without the necessary permit to drive and as such, trisikad drivers are required to submit themselves to a seminar to be conducted by the Philippines National Police, prior to the issuance of a permit to drive the trisikad.


    Section 6

    For every permit to drive issued, there shall be an imposition of twenty (P20.00) pesos in addition to the necessary clearances for every trisikad driver annually, at the Office of the Municipal Treasurer.


    Section 7

    There shall be assigned number and a notation that the unit is for hire for every trisikad, for easy identification.


    Section 8

    There shall be installed at least a headlight to be used during night time, for every trisikad unit.


    Section 9

    Penalty. Any violation of this ordinance shall subject the violator to a fine of not less than one thousand (P1,000.00) pesos, but not more than two thousand five hundred (P2,500.00) pesos, or an imprisonment of not less than three (3) months, but not more than six (6) months, or both, at the discretion of the court.


    Section 10

    Repealing Clause. All ordinances or parts thereof inconsistent with this ordinance are hereby repealed and/or rescinded.


    Section 11

    This ordinance shall take effect retroactive January 1, 1992.
