AN ORDINANCE CREATING THE LOCAL TRANSPORT BOARD (LTB) OF 2004 IN THE MUNICIPALITY OF CATARMAN, CAMIGUIN.
BE IT ORDAINED, by the Sangguniang Bayan of Catarman, Camiguin, in its regular session the following:
Section 1
Title. This ordinance shall be known as the Local Transport Board (LTB) of 2004.
Section 2
Definition of words and phrases
The following words, phrases and terms used in this ordinance shall mean as follows:
A. Local Transport shall include the following:
A1. Motorelas (with motorcycles or improvised engine)
A2. Tricycle (motorcycle or improvised engine)
A3. Habal-habal (single motorcycles
A4. Trisikad (bicycle with a side car)
B. Operators are registered owners of the transport unit
C. Local Transport Board shall mean the organized body and means of control of the operations of the motorelas, tricycles, single transport motorcycles or habal-habal and trisikad authorized to do business in Catarman, Camiguin and recommend it for approval and adoption by the Sangguniang Bayan.
Section 3
Creation. There shall be created Local Transport Board (LTB) a body to draw a design the regulatory requirements and control of the operation of local transport units operating within the Municipality of Catarman.
Section 4
Composition. The following shall compose the Local Transport Board, to wit:
Chairman: SB Chairman – Committee of Public Utilities & Facilities
Members: Chief of Police – PNP
President - Transport Operators Association
Municipal Engineer
Liga ng Barangay President
designated by the Council
Section 5
Powers. Duties and Responsibilities. The Local Transport Board shall have the following powers and responsibilities:
A. The LTB shall have the supervisory power over the operation of the local transport unit and granted by the Sangguniang Bayan.
B. The LTB shall draw the required regulations and control of the operation of the transport unit referred to in this ordinance and to recommend its approval and adoption to the Sangguniang Bayan.
C. The LTB shall from time to time recommend for the amendment of the authorized fare and freight charges of the local transport when necessary.
D. The LTB shall perform other duties necessary for the development and advancement of the local transport industry.
Section 6
Transitory Provision. Immediately after this ordinance is approved and took its full force and effect the operations of all local transport shall be placed under the supervision of the Local Transport Board (LTB)
Section 7
Separability Clause. If whatever reason part of this ordinance will be declared invalid or unconditional the other provisions not affected shall remain in full force and effect.
Section 8
Repealing Clause. Other existing ordinances or issuances which provisions are inconsistent with this ordinance are deemed repealed and or amended.
Section 9
Effectivity Clause. This ordinance shall take effect immediately upon approval and after all the basic requirements are satisfied.
