2010 ORDINANCE NO. 4

AN ORDINANCE ESTABLISHING AN ALLEY SYSTEM FOR ALL TYPES OF LAND TRANSPORTATION PASSENGER VEHICLES, OPERATING IN THE MUNICIPALITY OF CATARMAN, ISLAND PROVINCE OF CAMIGUIN AND FOR OTHER PURPOSES.


BE IT ORDAINED by the Sanggunian Bayan of Catarman, Camiguin, in session, assembled:


Section 1

TITLE  This piece of legislation shall be known and referred to as Alley Ordinance.


Section 2

DECLARATION OF POLICY The following are hereby declared to be among the policies of the Local Government Unit:

2.a To promote harmonious relationship among the drivers themselves and between drivers and the riding public; and

2.b To uphold an orderly, peaceful and smooth operation of all vehicles operating within the bounce of its jurisdictional limitations.


Section 3

DEFINITION OF TERMS - Unless the context otherwise indicate, the following shall be construed:

3.a ALLEY - is narrow lane provided for in a designated as a passage way for certain LAND TRANSPORTATION PASSENGER VEHICLES, insofar as this ordinance is concerned;

3.b ALLEY SYSTEM - an orderly and a systematic forming of a single file of Land Transportation Passenger Vehicles such as PU, PUJ, BUS, MOTORIZED TRICYCLE, MOTORELA, SINGLE MOTORCYCLE, locally known as “HABAL-HABAL”, OTHER MOTORIZED RUNNING STRUCTURE, and TRI-SIKAD, on a designated alley. A unit that arrives first in its designated alley has a preferential right to line up ahead of the other latecomers and the first one to pick up and load the passenger/s and cargo/es. The succeeding arrivals (vehicles) shall follow suit strictly in the same order of preference as hereinabove stated;

3.c LAND TRANSPORTATION PASSENGER VEHICLES/COMMOM CARRIERS - refers to all types of land transportation vehicles or common carriers mentioned in the immediately preceding provisions under the alley system;

3.d ROADWORTHY - means an A-I conditions Land Transportation Passenger Vehicles referred to above, including its roof, sidewall, flooring, spare parts, and other necessary items attached thereto;


Section 4

All common carriers returning back to their respective designated alleys from their routinary trips are allowed to deliver first their passenger/s and cargo/es provided that the place where the passenger or passengers and cargo/es are to be delivered is within the Poblacion of this municipality, and provided further that immediately thereafter they should go back to their assigned alleys, unless delayed for a reasonable cause.


Section 5

The following are the alleys designated on certain streets for the Land Transportation Passenger Vehicles to occupy, as hereunder indicated.

ALLEY ONE -  North west bound motorized tricycles, motorela and other similar passenger carrying vehicles.


ALLEY TWO -  North bound motorized tricycle, motorelas and other similar units.

To occupy Procopio Rañin Street, at the dice of the Rañin building;


ALLEY THREE - South-east bound PUJ, Bus, or similar in structure of PUJ or Bus. At the terminal.


ALLEY FOUR - Bound to any point within the Poblacion, Catarman, Camiguin, Motorized Tricycles, motorelas, other similar units and Tri-sikad.

To occupy the Procopio Rañin Street, immediately beside the public market.


ALLEY FIVE - South-east bound motorized tricycle, motorelas and other similar passenger vehicles.

To occupy Epifanio Jacot Street, immediately beside Mrs. Soledad (Cholly) Neri Jacot’s Buildiing.


ALLEY SIX - From the Poblacion to any point in the municipality of Catarman single motorcycle, known as “habal-habal”.

To occupy Procopio Rañin Street down to Alejandro Magtajas Street immediately beside the Camiguin Petron Services Station.


ALLEY SEVEN - North-west bound PU, Bus and other similar passenger vehicles.


At the terminal.


Section 6

The Alleys where the Passenger Vehicles are designated to occupy are at the same time their respective loading, unloading and parking areas. The exception is provided for under Section 4 above.


Section 7

Notwithstanding the designated alley for motorelas, motorized tricycles, other similar running structures for passengers and/or the tri-sikad. Operating within the Poblacion of this municipality, said passenger carriers may freely rove around or strike anywhere within the boundary of the Poblacion to pick up passengers and load light cargoes. However, these utility vehicles are banned strictly to pick up passengers and/or load light cargoes bound for or destined to different barangays outside the Poblacion, of this municipality.


Section 8

POBLACION BOUNDARY. The limit of Poblacion boundary of Catarman this province stretches from Ubaldo Gaa Street, located between the Camiguin National High School and the Catarman Central School to “SAPA PUTI” Bridge, located between Tabid and Cagadas residences, including upper sitios enclosed by and between the two boundaries.


Section 9

A yellow line shall be drawn in every alley and the signboard marking the number of an alley and the inscription of the direction where the passenger vehicles are bound for, shall be provided, necessarily the cost of the materials and labor shall be taken from any available savings of different fund sources, otherwise a supplemental budget shall be legislated for this purpose.


Section 10

Driving without license or driving a land transportation passenger vehicle not currently registered and not fully equipped with other paper requirements is strictly prohibited.


Section 11

Persons below 18 years of age are not allowed to drive any land transportation vehicle as herein defined.


Section 12

PUBLIC BARKER - a public barker hired by the Catarman Tricycle and Motorela Drivers Association (CATRIMODA) to announce the alley placement for every passenger land transportation vehicle concerned shall strictly comply the provisions off this ordinance and hereby  authorize to report to a person in authority or his agent any person violating this ordinance.


Section 13

PENALTY CLAUSE - Any person found violating this ordinance shall be fined in the amount of One Thousand (P1,000.00) Pesos or an imprisonment not exceeding five (5) days or both at the discretion of the court.


Section 14

SEPARABILITY CLAUSE – Should any provision of this ordinance or part thereof be declared unconstitutional or invalid, the other provisions separable from the flaws shall remain in full force, valid and effective.


Section 15

REPEALING CLAUSE  - All ordinances, issuances, local laws, and/or an executive orders, inconsistent with the provisions of this ordinance are hereby repealed or amended accordingly.


Section 16

EFFECTIVITY  - This ordinance shall take effect immediately after complying the publication or posting requirement, pursuant to Republic Act. No. 7160, otherwise known as the Local Government Code of 1991.
